劳动安全中介组织法律制度研究

【摘要】：我国在发展生产的过程中,政府多次强调安全生产、安全发展的理念,但是在实践中瓦斯爆炸、矿难事故仍然此起彼伏。这些血淋淋的事故,损失巨大。痛定思痛之余,我们应该认真反思当前政府安全监管和安全服务的不足之处,应该充分考虑如何让劳动安全中介组织加入到安全工作中来。 政府职能转变的过程中,政府要把管不好,管不了的事情转移出去,集中精力加强对经济社会的宏观管理。政府需要社会中介组织来承担政府转移出去的部分职能,安全监管领域转移出来的职能需要安全中介组织来承接。市场经济繁荣的过程中,蓬勃发展起来的企业所需要的安全服务与日俱增,仅仅依靠政府来满足企业日益增加的安全需求显然难以实现。劳动安全中介组织为企业提供专业化的安全服务提上了议事日程。此外,严峻的安全生产形势呼唤更专业的安全监督,更实时化的安全监管,急需更多的劳动安全科学研究力量去攻克劳动安全的难关。不论是安全服务,还是专业化、实时化的安全监管,劳动安全中介组织都能胜任。在国外先进工业国家比如德国、法国,我国的香港特别行政区,都早已让安全中介组织担当起协助政府实施安全监管的任务。我国如何让劳动安全中介组织协助政府实施安全监管,提高政府安全监管水平值得探讨。劳动安全中介组织的重要性日益凸显,但是我国相关理论研究和法律制度却相当的薄弱,在此背景下,本文探讨了劳动安全中介组织的概念、特征和应然性质,阐述了它的权利义务。介绍了政府如何对它进行培育和监管。法治社会要求任何主体都要对它的行为独立地承担法律责任。本文对劳动安全中介组织的法律责任,也作了理论探讨。
[Abstract]:In the process of development of production in our country, the government has emphasized the concept of safe production and safe development many times, but in practice, gas explosion and mine accidents still occur one after another. These bloody accidents cost a lot of money. In addition to learning from the pain, we should seriously reflect on the shortcomings of the current government safety supervision and security services, and consider how to let the labor safety intermediary organizations join in the safety work. In the course of the transformation of government functions, the government should shift out matters that are not well or unmanageable, and concentrate on strengthening macro management of the economy and society. The government needs social intermediary organizations to undertake some functions transferred out by the government, and the functions transferred from the field of safety supervision need safety intermediary organizations to undertake. In the process of the prosperity of market economy, the security services needed by the booming enterprises are increasing day by day. It is obviously difficult to meet the increasing security needs of the enterprises only by relying on the government. The labor safety intermediary organization has put on the agenda for the enterprise to provide the specialized safety service. In addition, the severe situation of production safety calls for more professional safety supervision, more real-time safety supervision, and needs more scientific research on labor safety to overcome the difficulties of labor safety. Whether it is safety service, or professional, real-time safety supervision, labor safety intermediary organizations are competent. In foreign advanced industrial countries, such as Germany, France and the Hong Kong Special Administrative region of China, security intermediary organizations have already taken on the task of assisting the government in carrying out safety supervision. It is worth discussing how to let labor safety intermediary organizations assist the government to implement safety supervision and improve the level of government safety supervision. The importance of labor safety intermediary organizations is becoming increasingly prominent, but the relevant theoretical research and legal system are rather weak in China. Under this background, this paper discusses the concept, characteristics and supposed nature of labor safety intermediary organizations. Its rights and obligations are expounded. It introduces how the government cultivates and supervises it. The society of rule of law requires any subject to bear independent legal responsibility for its behavior. This article also makes a theoretical discussion on the legal responsibility of labor safety intermediary organizations.
