劳动法领域的企业社会责任研究

【摘要】：本文从我国女性公平就业现实困境与企业社会责任分配困境入手，提出了关于企业社会责任的存废与性质方面的学界争论，通过分析争论，笔者提出了在劳动法领域，企业社会责任存在和发展的合理性以及明确企业社会责任性质的重要性。随后，笔者通过在历史维度下对中外企业社会责任发展的分析，揭示了在我国坚持和强调企业经济人格独立性的重要意义；通过在逻辑维度下对企业的社会责任、经济责任、法律责任、道德责任的比较分析，揭示了企业经济责任与企业社会责任间原生与次生的关系，企业社会责任中的法律责任与道德责任间底线与鼓励的关系，并认为道德责任占据企业社会责任的主体部分，并是企业社会责任得以存在和继续发展的重点组成部分，法律责任有底线性和强制性的特点，法律责任以道德责任为基础，，共同构成整个企业社会责任；通过在现实维度下对企业社会责任发展的分析，对我国企业社会责任运动进行了反思，并从宏观、中观、微观等角度尝试了重新定位。最后，笔者就完善我国企业社会责任制度的提出了建议，要在明晰企业责任与政府社会责任的界限的基础上，强化政府在完善我国企业社会责任中的激励引导职能；要充分发挥非政府组织在完善我国企业社会责任中的作用；同时，建立符合国情的企业社会责任运行体系。
[Abstract]:Starting from the realistic dilemma of female fair employment and the dilemma of corporate social responsibility distribution in China, this paper puts forward the academic controversy about the existence and nature of corporate social responsibility. Through the analysis of the controversy, the author puts forward that it is in the field of labor law. The rationality of the existence and development of corporate social responsibility and the importance of clarifying the nature of corporate social responsibility. Then, by analyzing the development of corporate social responsibility in China and foreign countries in the historical dimension, the author reveals the importance of insisting on and emphasizing the independence of enterprise economic personality in our country. Through the comparative analysis of corporate social responsibility, economic responsibility, legal responsibility and moral responsibility in the logical dimension, this paper reveals the primary and secondary relationship between corporate economic responsibility and corporate social responsibility. The relationship between legal responsibility and moral responsibility in corporate social responsibility and the relationship between bottom line and encouragement, and the view that moral responsibility occupies the main part of corporate social responsibility and is the key component of the existence and continuous development of corporate social responsibility. The legal responsibility has the characteristic of bottom line and compulsory. The legal responsibility is based on the moral responsibility and constitutes the whole corporate social responsibility. Through the analysis of the development of corporate social responsibility in the realistic dimension, this paper reflects on the movement of corporate social responsibility in China, and attempts to reposition it from the macro, meso and micro perspectives. Finally, the author puts forward some suggestions on how to perfect the system of corporate social responsibility in China. On the basis of clarifying the boundary between corporate responsibility and government social responsibility, we should strengthen the incentive and guidance function of the government in perfecting our country's corporate social responsibility. It is necessary to give full play to the role of non-governmental organizations in perfecting our country's corporate social responsibility, and at the same time, to establish a running system of corporate social responsibility in line with the national conditions.
