工伤事故保险赔偿与民事侵权损害赔偿的适用关系

【摘要】:人类社会的工业化进程,在极大地解放生产力的同时,因工伤带来的社会压力和社会矛盾也十分突出。为了充分保护劳动者的合法权益,也为了减轻用人单位的经营风险,世界各国纷纷建立并完善了工伤保险制度。工伤保险制度对于缓解工业化带来的社会压力和社会矛盾、保护劳动者的权益、促进安全生产等方面,都起到了积极的作用。我国1951年2月26日颁布实施了《劳动保险条例》,1953年1月2日国务院发布了《关于中华人民共和国劳动保险条例若干修正的决定》,同时公布了修正后的《劳动保障条例》,1953年1月26同劳动部试行了《中华人民共和国劳动保险条例实施细则修正草案》,规定了工伤保险的范围和待遇。上述系列规定确定了我国工伤保险的一些基本原则,奠定了我国工伤保险法律制度的基础。2003年4月27日国务院颁布实施的《工伤保险条例》确定了我国工伤事故保险责任处理的基本原则和具体方法,这是1951年发布、1953年修正《劳动保险条例》以来第一次作出的具体规范工伤事故处理的法规。 由于工伤的发生不仅是由职业危害发生的,还可能是由于用人单位或第三人的过错造成,如用人单位未依法提供劳动安全保护措施或第三人对履行工作职责的劳动者进行人身伤害导致劳动者伤、残、亡等,因此,当工伤事故一旦发生,受害职工是按照《工伤保险条例》的规定,向用人单位提起工伤保险赔偿申请,还是依照侵权行为法的相关规定向用人单位或第三人提起民事诉讼,这便成为摆在用人单位和受害职工面前的一个不可回避的事实。世界各国在解决这一问题上,通常有四种模式:取代模式、兼得模式、选择模式、补充模式。
[Abstract]:The industrialization process of human society, while greatly liberating the productive forces, the social pressure and social contradictions brought about by industrial injury are also very prominent. In order to fully protect the legitimate rights and interests of labourers, and to reduce the operational risk of employers, various countries have established and improved the industrial injury insurance system. Industrial injury insurance system plays a positive role in alleviating social pressure and social contradiction, protecting workers' rights and interests, promoting production safety and so on. China promulgated and implemented the regulations on Labor Insurance on February 26, 1951, the State Council issued a decision on certain amendments to the regulations on Labor Insurance of the people's Republic of China on January 2, 1953, and at the same time promulgated the amended regulations on Labour Security. On January 26, 1953, the revised draft of the regulations of the people's Republic of China on the implementation of Labor Insurance was tried out with the Ministry of Labour, which stipulated the scope and treatment of industrial injury insurance. The above-mentioned series of regulations have established some basic principles of industrial injury insurance in China. On April 27, 2003, the regulations on Industrial injury Insurance promulgated by the State Council established the basic principles and specific methods for dealing with the liability of industrial injury insurance in China, which was issued in 1951. Regulations regulating the handling of industrial accidents for the first time since the Labor Insurance regulations were amended in 1953. Because the occurrence of an industrial injury is not only caused by occupational harm, but may also be caused by the fault of the employing unit or a third person. If the employing unit fails to provide labor safety protection measures according to law or the third party carries out personal injury to the labourers performing their work duties, resulting in injury, maiming and death of the labourers, therefore, in the event of an industrial injury accident, Is the injured worker filing an application for compensation for industrial injury insurance to the employing unit in accordance with the provisions of the regulations on Industrial injury Insurance, or filing a civil action against the employing unit or a third person in accordance with the relevant provisions of the tort law? This has become an unavoidable fact in front of employers and victimized workers. There are usually four models to solve this problem in the world: substitute model, both-gain model, choice model and supplementary model.
