东源县农民工维权影响因素分析

【摘要】:东源县作为河源市工业基地,2010年开始承接珠三角产业转移,企业众多,劳动力需求旺盛。近年来,农民工劳动纠纷案件呈上升趋势。但是由于农民工维权意识不高,缺乏正确维权方式,时常有消极怠工、集体罢工,甚至是选择自残、跳楼、危害社会公共安全的方式进行维权的行为发生,激化社会矛盾,对劳动者本人,用人单位及社会都产生不利的影响,阻碍地区经济社会的和谐发展。本文的研究是基于进一步做好为农民工服务工作的重要性,积极探索中国特色农业劳动力转移道路的要求。本文选取河源市东源县农民工维权的典型个案及该县劳动监察部门2013年以来当地农民工维权的案件卷宗及统计数据为切入点,结合当地农民工维权现状,设计农民工维权影响因素的调查问卷,并对问卷数据相关性进行分析。本文在分析农民工基本特征变量(如性别、年龄、学历、行业等)的基础上,重点考察农民工的收入水平、侵权经历、签订劳动合同、购买保险、加入组织、接收劳动法培训几类变量对当地农民工维权行为方式的影响与作用,展现广东粤东北欠发达地区东源县农民工维权的现状、问题及其影响因素。本文对东源县农民工维权的典型个案进行案例分析,采用SPSS软件对调查问卷数据进行维权影响因素相关性分析,系统性地分析东源县农民工维权行为。经过论文分析,本文得出以下结论:年龄因素、受教育程度、收入、是否签订劳动合同、所在行业、是否遭受侵权、是否接触过劳动法认知培训这七个本文研究的因素均会影响被调查者在维权方式上的选择,而其他几个因素,如性别、工资发放形式、是否购买保险、是否加入社会组织等则对被调查者在维权方式上的选择影响不大。根据多因素影响东源县农民工维权行为的选择分析,本文提出政府应加快建设推进适合当地农民工特点的社会保险制度;社会组织力量如工会、农民工组织、同乡会等对维权助力应加大;拓宽制度化维权之外的维权路径等政策。
[Abstract]:Dongyuan County as the industrial base of Heyuan City, began to undertake the Pearl River Delta industrial transfer in 2010, numerous enterprises, labor demand is strong. In recent years, migrant workers labor dispute cases are on the rise. However, due to the low awareness of protecting the rights of migrant workers and the lack of correct ways of safeguarding their rights, there are often negatives, collective strikes, and even the choice of self-harm, jumping out of buildings and endangering social public safety to carry out the behavior of safeguarding rights, thus exacerbating the social contradictions. It has adverse effects on labourers themselves, employers and society, hindering the harmonious development of regional economy and society. The research in this paper is based on the importance of serving migrant workers and actively exploring the transfer of agricultural labor with Chinese characteristics. In this paper, the typical cases of migrant workers' rights protection in Dongyuan County, Heyuan City, and the case files and statistical data of local migrant workers' rights protection since 2013 in Dongyuan County of Heyuan City are selected as the starting point, and combined with the status quo of local migrant workers' rights protection, Designed the questionnaire of influencing factors of migrant workers' rights protection, and analyzed the correlation of questionnaire data. Based on the analysis of the basic characteristics of migrant workers (such as gender, age, education, industry, etc.), this paper focuses on the income level of migrant workers, the experience of infringement, the signing of labor contracts, the purchase of insurance, and joining the organization. The influence and effect of receiving labor law training variables on the behavior of local migrant workers' rights protection, showing the status quo, problems and its influencing factors of migrant workers' rights protection in Dongyuan County, less developed area of Guangdong and northeast Guangdong. This paper analyzes the typical cases of migrant workers' rights protection in Dongyuan County, uses the SPSS software to carry on the correlation analysis to the questionnaire data, and systematically analyzes the rights protection behavior of the migrant workers in Dongyuan County. Through the analysis of the thesis, this paper draws the following conclusions: age factor, education level, income, whether to sign a labor contract, the industry, whether to suffer infringement. Whether or not exposure to labor law awareness training, the seven factors studied in this paper will affect the respondents in the way of rights choice, and other factors, such as gender, the form of pay, whether to buy insurance, the other factors, such as gender, the form of wages, whether to buy insurance, Whether to join the social organization or not has little influence on the choice of the way of safeguarding the rights of the respondents. According to the analysis of the choice of multi-factors affecting the rights-safeguarding behavior of migrant workers in Dongyuan County, this paper puts forward that the government should accelerate the construction of the social insurance system suitable for the characteristics of local migrant workers; Social organizational forces such as trade unions, migrant workers' organizations, local associations and other policies should be increased to safeguard rights and broaden the way to safeguard rights other than institutionalized rights protection.
