论立法文本英译之中的翻译转移

翻译转移是一种普遍存在于各类文体翻译中的现象,如在中文立法文本的英译。然而,学术界几乎没有对中英互译中的翻译转移现象进行分析,更谈不上在法律翻译中研究翻译转移。为此,本文尝试对立法文本英译之中的翻译转移进行描述性研究。本文提出了三个研究问题:1.在立法文本英译之中存在哪些种类的翻译转移? 2.判断翻译转移的适当与否,需要哪些标准?3.翻译转移是否遵从提出的标准? 本文把翻译转移定义为“在译文中所有异于原文的表达方式,或所有没有如理想般出现的表达方式”,且本文阐明翻译转移分析应当是描述性的而不是规定性的。中文立法文本英译的翻译转移可从微观角度和宏观角度分析。微观层次的翻译转移可分为层次转移、单位转移、结构转移、类型转移和系统转移,而宏观层次的翻译转移可分为语义转移和语用转移。本文继而试图提出两个标准以衡量翻译转移的适当性:语言标准和法律标准是评判翻译转移的可接受性的准则。 本文从几部中文法律和法规中选取众多范例,用提出的分类和框架和Munday设计的格式按翻译转移的类型加以分析。本文证实了在中文立法文本英译之中存在着七类翻译转移,并确...
