网络环境下著作权保护研究

【摘要】：随着科学技术的发展,在我们日常生活中,互联网作为一种作品传播媒介扮演着越来越重要的角色。我们在享受互联网给予便利的同时,也产生了一些负面影响——网络环境下的著作权侵权案件不断增加。从表面上看,网络环境下的著作权侵权是由于网络的开放性及虚拟性造成的,但究其本质是网络环境下的各个主体之间经济利益的矛盾,以及我国法律制度的不完善造成的。因此,对网络环境下的著作权保护刻不容缓。我国需要不断地借鉴外国以及国际组织的相关理论与实践经验,逐步完善相关的法律法规,才能为我国著作权人提供更好的法律保护。只有这样,才能保证网络健康有序的发展,这不仅有利于我国经济的可持续发展,而且也有利于社会秩序的稳定。本文除了引言和结论以外共分为四个部分：第一部分,“网络环境下著作权的界定”,首先对传统著作权以及网络环境下的著作权的概念以及特征进行介绍,进而了解到两者的异同。其次从网络环境下的著作权人、网络服务商以及网络用户这三类主体对网络环境下所涉主体的权利与义务进行分析。第二部分,“网络环境下著作权易受侵害的常见形式及原因分析”,首先将网络环境下的几种常见侵权形式进行列举,使读者对网络环境下的侵权更易理解。其次本文从六个方面对网络环境下著作权的易受侵害的原因进行了详尽地分析与论述。第三部分,“国外法律对网络环境下著作权保护的规定”,本文对美国、法国、日本、芬兰以及国际条约关于网络环境下的著作权保护相关规定进行介绍,为第四部分提出完善建议,做了铺垫。第四部分,“完善我国网络环境下著作权保护的建议”,首先对国内以及国外关于网络环境下著作权的保护措施进行分析得出,我国对网络服务商的保护要更加全面,而对于著作权人以及网络用户的保护方面有些疏漏,从而得出相对完善的建议。其次本文从立法、司法、执法以及其他方面提出了对网络环境下著作权保护的完善建议。
[Abstract]:With the development of science and technology , the Internet is playing more and more important role as a kind of work communication medium in our daily life . In addition to the preface and conclusion , this paper is divided into four parts : The first part , the definition of copyright in the network environment , first introduces the concept and characteristics of the copyright in the traditional copyright and the network environment , and then the similarities and differences between them . Secondly , the author analyzes the rights and obligations of the subjects under the network environment from the copyright owner , the network service provider and the network user under the network environment . The second part , " the common form and cause analysis of the infringement of copyright in the network environment " , firstly lists several common tort forms under the network environment , and makes the readers understand more easily under the network environment . Secondly , this paper analyzes and discusses the causes of the infringement of copyright in the network environment from six aspects . In the third part , the article introduces the copyright protection in the network environment by foreign law , and introduces the relevant regulations about the copyright protection under the network environment in the United States , France , Japan , Finland and international treaties . The fourth part , " perfecting the proposal of copyright protection in our country ' s network environment " , firstly analyzes the protection measures of the copyright in the domestic and foreign countries on the network environment , and makes some omissions to the protection of the copyright owner and the network user , so as to obtain the relatively perfect suggestion . Secondly , this paper puts forward the suggestion of perfecting the copyright protection in the network environment from the legislative , judicial , law enforcement and other aspects .
