【摘要】:伴随着我国《不动产登记暂行条例》的实行,如何登记不动产成为近期人们讨论的热门话题。我国此前施行的“多部门、多级别”的不动产登记制度造成了法理上的混乱,权利人的利益也得不到充分的法律保护,社会的形势要求我们尽快建立统一的不动产登记制度。人们在保护自己的物权的同时,也在关注着不动产如何登记方为有效,才可以受到法律的承认及保护;不动产的相关的登记机构也在关注日后不动产登记实务操作的具体变化。不动产登记中有关登记程序的规定在法理上叫做“物权公示”。这种登记具有民法上的物权公示性质,是民事主体的财产权利在国家不动产登记机关的登记。凡经过合法程序登记的不动产,将受到我国法律的保护,这是我国市场经济体制下的法律制度,将对我国社会政治经济的发展和民众权利的保护发挥巨大作用。不动产登记的目的是客观、公正、有序地保护不动产登记中涉及的申请人、权利人、利害关系人,以维护真正的不动产权利人的合法权利,加强不动产交易的安全促进不动产交易市场的繁荣。不动产登记一般程序包括登记申请、登记申请撤回、现场申请和申请材料受理、不动产登记查验、实地察看和调查、办结手续的期限、完成登记、不予登记等九个方面。不动产登记的特别程序主要包括派出登记、预告登记、异议登记、等。《不动产登记暂行条例》存在不完善之处或不合理之处,未来在立法论上还应进一步完善。
[Abstract]:With the implementation of the Provisional regulations on Registration of Real Estate in China, how to register immovable property has become a hot topic discussed recently. Multi-level "real estate registration system has caused legal confusion, and the interests of the obligee can not be fully protected by law." The social situation requires us to establish a unified real estate registration system as soon as possible. While protecting their own real right, people are also paying attention to how the real estate registration party is effective in order to be recognized and protected by the law. The relevant registration institutions of real estate are also concerned about the specific changes in the practice of real estate registration in the future. The provisions on registration procedure in real estate registration are called "real right publicity" in legal theory. ... such registration is of a civil law nature of publicizing property rights. Property rights of civil subjects are registered by the state real estate registration authority. Real estate registered through legal procedures will be protected by the laws of our country, which is the legal system under the market economy system of our country. The purpose of real estate registration is to protect the applicants and right holders involved in the registration of real estate objectively, fairly and in an orderly manner. Interested parties, in order to safeguard the legitimate rights of real estate owners, enhance the security of real estate transactions to promote the prosperity of the real estate market. There are nine aspects of acceptance of on-site application and application materials, registration and inspection of immovable property, on-the-spot inspection and investigation, completion of formalities, completion of registration, non-registration, etc. The special procedures for registration of real estate mainly include dispatch registration. Notice registration, dissenting registration, etc. Interim regulations on Real Estate Registration are imperfect or unreasonable, and should be further perfected in the legislative theory in the future.
