保险消费纠纷非诉讼解决机制的问题研究

【摘要】:保险消费纠纷非诉讼解决机制,是指通过诉讼外的方式解决发生在保险消费者及保险服务提供者之间争端处理程序的总称。日益繁荣的保险市场,与相对滞后的法律与制度保障,使得保险消费纠纷增长明显。单一的诉讼方式难以解决大量的保险消费纠纷,保险消费者的合法权益也无法得到全面的保障,非诉讼解决机制恰能弥补诉讼的缺陷。本文旨在对我国目前保险消费纠纷非诉讼解决机制中的部分问题进行探析,并提出作者的思考和观点。文章分为三部分内容,第一部分为导言,第二部分为正文,第三部分为结语。其中,第二部分正文又分为三章。第一章为保险消费纠纷和保险消费纠纷非诉讼解决机制概述。先通过分析金融消费者的概念,再定义其下位概念“保险消费者”,明确了保险消费者的范围;随后分析了保险消费者的弱势性以及保险消费纠纷的特殊性,以突出保险消费纠纷与其他普通金融消费纠纷相比的特殊性及复杂性;正因为此,非诉讼解决机制成了保险消费者遇到纠纷时重要的权利救济途径,该机制的建立也为保险消费者权益的保护增添了一道制度性屏障,这也是本文与其他类型的金融消费纠纷研究相比较的价值之所在;最后简要介绍了主要国家的相关机制的情况。第二章为我国保险消费纠纷解决机制现状及域内外比较研究。从对我国保险消费纠纷的解决途径近况和亟需解决问题的扼要分析,从金融保险机构内部纠纷解决制度、保险消费者仲裁制度、金融监管部门纠纷协调制度、金融督察服务制度等四个方面,从横向上,对域内外的相关情况作比较研究。第三章为我国保险消费纠纷非诉讼解决机制的思考。该章分为两个部分,首先是传统的调解、投诉、仲裁在当前我国非诉讼解决机制的现状中潜力有限,而后是创设全新的第三方解决机制。随着保险行业的发展,保险消费纠纷非诉讼解决机制的运行能有效、快速解决纠纷,更好地保护保险消费者的合法权益,同时促进行业良好的发展。
[Abstract]:The insurance consumer disputes resolution, refers to the litigation way to solve the dispute between the general procedure of insurance consumers and insurance service providers. The growing prosperity of the insurance market, and the legal and institutional guarantee of lagging behind, the insurance consumer disputes increased significantly. It is difficult for the single mode of litigation to solve a large number of insurance consumption insurance disputes, the legitimate rights and interests of consumers can not be fully protected, the defects of non litigation settlement mechanism can make up the litigation. This paper aims to present the insurance consumer disputes in non litigation to resolve some of the problems in system analysis, and puts forward the thoughts and ideas of the author. The article is divided into three parts, the first part is the second part is the main body, the third part is the conclusion. The second part of the text is divided into three chapters. The first chapter is the insurance consumer disputes and insurance consumers. Not the overview of non settlement mechanism of litigation. By analyzing the concept of financial consumers, and then define the concept of "insurance consumer", defined the scope of insurance consumers; then analyzes the particularity of insurance consumers vulnerable and insurance consumer disputes, to highlight the particularity and complexity of insurance consumer disputes and other common financial consumer disputes compared; because of this, the non litigation mechanism into the insurance consumer disputes encountered when important rights remedies, the establishment of mechanisms for the protection of the rights and interests of insurance consumers also adds to the institutional barrier, where it is the study of financial consumer disputes and other types of comparable value; finally briefly introduced the related mechanism in the main countries. The second chapter is the comparative study of insurance consumer disputes in China to solve the current situation and mechanism. From inside and outside the domain of China's insurance. A brief analysis of the current situation and the fee dispute solution to solve the problem, from the financial and insurance institutions internal dispute settlement system, consumer arbitration system of insurance regulatory system of financial disputes, coordination, the four aspects of financial supervision service system, from the horizontal comparison, research situation of inside and outside the region. In the third chapter, the insurance consumer disputes I think in the non litigation settlement mechanism. This chapter is divided into two parts, the first is the traditional mediation, arbitration complaint, limited potential in the status of the non litigation settlement mechanism in our country at present, which is the creation of new third party settlement mechanism. With the development of the insurance industry, the insurance consumer ADR the operation can effectively and quickly resolve disputes, to better protect the legitimate interests of insurance consumers, and promote the industry good development.
