商业秘密法律保护中的价值衡平

【摘要】：无论是中国还是世界其他国家,法律发展的过程都可以说是一部价值的冲突与衡平史。当法律主体复杂的价值需求面对具有单一属性的法律客体时,各种价值需求难以被一一满足,一种法律价值的选择往往会造成其他法律价值的牺牲。究其本质,是社会价值与个人价值间的冲突和衡平。社会价值和个人价值各自又包含着各种不同的法律价值,他们同时存在于人们的理念中,引导人们既要保护自己的合法利益,又要维护社会的正义与公平。引起价值冲突的原因,既有主观上认识论以及思维模式的影响,也与客观上利益多元化和法律调节纠纷模式有关。关于对商业秘密保护的相关法律属于整个法律体系的一部分,两者属于个性和共性间的关系。法律价值冲突的本质、主客观原因同样也适用于商业秘密法律保护之中。当然,在商业秘密的法律保护中,存在着其独特的价值冲突,需要我们具体问题具体分析,树立正确的商业秘密法律价值衡平方法论以及立法标准。针对目前我国制度设计存在缺陷的情况下,运用正确的价值衡平理论作为指导,借鉴吸收其他国家法律设计经验就十分之必要。
[Abstract]:Whether in China or other countries in the world, the process of legal development can be said to be a conflict of value and balance history. When the complex value needs of the legal subject face the legal object with a single attribute. Each kind of value demand is difficult to satisfy one by one. The choice of one kind of legal value will often lead to the sacrifice of other legal value. It is the conflict and balance between social value and individual value. Social value and individual value contain different kinds of legal value, they exist in people's idea at the same time. Guiding people not only to protect their legitimate interests, but also to maintain social justice and fairness. The causes of value conflicts are subjective epistemology and the influence of thinking patterns. It is also related to the objective diversification of interests and the mode of legal regulation of disputes. The relevant laws on the protection of trade secrets belong to the whole legal system. The nature of the conflict of legal value, subjective and objective reasons also apply to the legal protection of trade secrets. Of course, in the legal protection of trade secrets. The existence of its unique value conflict requires us to analyze the specific problems, set up a correct legal value balance methodology and legislative standards of trade secrets, aiming at the defects of the current system design in our country. It is necessary to use the correct value balance theory as a guide and absorb the legal design experience of other countries.
