无权占有保护问题研究

【摘要】：占有制度是一项古老的民法制度,在不同的历史时期因为要与当时的经济和政治相适应所以有着不同的规定,在现代社会占有制度有着其不可替代的作用。其中对无权占有保护问题的研究也成为当前的热门研究话题。对无权占有的保护即能体现现代社会所展现的民法精神,更体现出对交易安全保护的重视。我国新颁布的《物权法》已经认识到占有制度的重要性,将其独立成篇,这在我国民法史上具有非常重要的意义。但是,关于占有的规定仅有五条,而且多为原则性规定,尤其对无权占有保护规定更是寥寥无几,这给实际运用带来了困难。本文运用民法原理结合法律规定分析无权占有保护的有关问题,希望能对实际的应用提供一些帮助。本文从以下四个方面来具体阐述无权占有保护问题：第一部分对无权占有的具体含义结合不同的学者们的观点进行分析,理解无权占有的具体含义以及分类,在形成对无权占有的初步概念基础上,结合现代生活对法律的要求阐述对无权占有进行保护的法理基础和重要意义。第二部分从世界各国对无权占有保护的制度进行分析,了解其他国家在这方面所采取的做法,比较各个国家制度的不同,结合各自国家的立法背景,进一步探究无权占有保护的意义和方法,同时结合我国的具体国情,找出适合我国的理论体系。第三部分根据我国《物权法》中对占有包括无权占有保护制度的研究,具体分析《物权法》对物权占有制度的保护,重点探讨了自力救济和占有保护请求权问题。第四部分从债权的保护方式上对无权占有保护进行研究,除了对占有人费用返还请求权进行分析外,还从侵权保救济的角度的角度对占有利益受到侵害时的救济问题进行了论证,以期最大可能弥补无权占有人的损失。
[Abstract]:Possession system is an ancient civil law system, in different historical periods because of the economic and political adaptation at that time, there are different provisions. In modern society, possession system plays an irreplaceable role, among which the research on the protection of unauthorized possession has become a hot research topic. The protection of unauthorized possession can reflect the essence of civil law displayed in modern society. God. The new property Law has recognized the importance of the possession system, which has a very important significance in the history of the civil law of our country. There are only five provisions on possession, and most of them are rules of principle, especially for the protection of unauthorized possession. This brings difficulties to the practical application. This paper uses the principles of civil law and legal provisions to analyze the protection of unauthorized possession. Hope to provide some help to the practical application. This article from the following four aspects to elaborate the protection of unauthorized possession: the first part of the specific meaning of unauthorized possession combined with the views of different scholars to analyze. Understand the specific meaning and classification of unauthorized possession, on the basis of forming a preliminary concept of unauthorized possession. According to the requirements of modern life to the law, this paper expounds the legal basis and significance of the protection of unauthorized possession. The second part analyzes the system of the protection of unauthorized possession from all over the world. Understand the approaches taken by other States in this regard, compare the differences in national systems, and further explore the significance and methods of protection without ownership, taking into account the legislative context of their respective countries. At the same time, according to the specific conditions of our country, find out the suitable theoretical system. The third part according to the "property Law" of our country, including the possession of the protection system of unauthorized possession. This paper analyzes the protection of the possession system of real right in the Real right Law, focusing on the issue of self-relief and the claim for possession protection. Part 4th studies the protection of unauthorized possession from the way of the protection of creditor's rights. In addition to the analysis of the claim right of the possessor's expense return, the author also demonstrates the problem of relief when the possession interests are infringed from the angle of tort protection and relief, in order to make up for the loss of the unauthorized possessor as much as possible.
