【摘要】：旅游合同中,由于旅行社的原因导致旅游行程未能按合同双方的预期顺利完成,旅游者的时间浪费能否请求旅行社赔偿?该种损害赔偿请求权的性质又如何?根据我国目前的立法现状,对于这方面尚无直接的法律规定,亦鲜见相关判例。而纵观域外国家地区,时间浪费损害赔偿早已经历了漫长的理论演进过程,实务中也已经实现与理论的衔接。时间浪费损害赔偿,不仅有利于全面救济旅游者这一市场相对弱势群体的合法权利,还能促进我国旅游立法水平的提升,因此,研究时间浪费损害赔偿很有必要。本文第一部分为课题研究背景意义与研究思路。该部分系统阐述了课题产生的背景和课题研究的目的和意义,指出我国对时间浪费损害赔偿问题的研究严重不足,并给出了本文大致的行文思路。本文第二部分为概述,该部分概述了国内外地区关于时间浪费损害赔偿的理论观点和实践经验。第三部分首先对时间价值进行了经济学考量,继而研究分析了时间浪费损害以及时间浪费损害请求权的性质,时间浪费损害为财产损害,时间浪费损害赔偿请求权是一种违约损害赔偿请求权。本文第四部分论述了时间浪费损害赔偿的具体组成要件。时间浪费损害赔偿的构建,必然会给旅行社相对带来一定的法律风险,为了平衡其和旅游者的利益,防止旅游者无限制地追求赔偿,必须严格规范旅游时间浪费损害赔偿的构成要件。本文第五部分详细阐述了时间浪费损害赔偿这种特殊的违约损害赔偿的赔偿原则、赔偿范围和赔偿方法。本文第六部分为结语,文章最后再次整理了全文思路,确认了时间浪费损害是一种以人格利益为内容的财产损害,针对旅游合同中旅游者可能遭受的旅游时间浪费损害,旅游者应当通过违约损害赔偿来救济自身的权利。
[Abstract]:In the travel contract, due to the reasons of the travel agency, the travel itinerary can not be completed smoothly as expected by both parties. Can the travel agency claim compensation for the time wasted by the tourist? What is the nature of the claim for damages? According to the current legislative situation of our country, there are no direct legal provisions in this area, and few relevant cases. But throughout the foreign countries, time wasted damage compensation has gone through a long process of theoretical evolution. The practice has also realized the link with the theory. Time wasted damage compensation is not only conducive to the comprehensive relief of tourists, the legal rights of the relatively vulnerable groups in the market, but also can promote the level of tourism legislation in China. Therefore, it is necessary to study the compensation for time wasted damage. The first part of this paper is the background significance and research ideas. This part systematically describes the background of the subject and the purpose and significance of the research. The author points out that the research on compensation for time wasting damages is seriously inadequate, and gives the general thinking of this paper. The second part of this paper is an overview. This part summarizes the theory and practical experience of compensation for wasted time in domestic and foreign areas. The third part of the economic consideration of the value of time. Then it analyzes the nature of time wasted damage and the claim right of time waste damage. Time wasted damage is property damage. The claim for time wasted damages is a claim for damages for breach of contract. Part 4th of this paper discusses the specific elements of time waste damage compensation and the construction of time waste damage compensation. It will inevitably bring certain legal risks to travel agencies in order to balance their interests with tourists and prevent tourists from pursuing compensation indefinitely. It is necessary to strictly regulate the constitutive elements of compensation for damages for wasting time in tourism. Part 5th of this paper expounds in detail the compensation principle of compensation for time wasted damage, which is a special breach of contract damages. Compensation scope and compensation methods. Part 6th of this article is the conclusion. Finally, the article rearranges the whole paper, and confirms that the time wasted damage is a kind of property damage with the content of personal interests. In view of the damage which the tourist may suffer in the travel contract, the tourist should remedy his right through the compensation for breach of contract.
