【摘要】：现今我国个人信息的安全问题已经成为社会热点,近年来我国理论界及实务界均不同程度的对这一问题展开研究,实务部门也出台了一些规制文件。但是,对于这一问题的研究与讨论,不同领域、不同部门的学者及实务工作者均各自从本领域、本部门的视角出发,无法高屋建瓴的对我国个人信息保护展开综合分析研讨。因此,笔者将从法理学的视角,运用文献研究、价值分析、比较研究的方法分析个人信息的概念、特征,多角度分析个人信息保护制度,指出我国个人信息保护制度存在的问题,并探索构建完善我国个人信息保护制度的途径。本文由引言、正文、结语组成,正文共分为四部分。第一部分论述了个人信息的概念及我国个人信息保护制度的现状。首先辨析了个人信息的概念,区分了个人信息与个人资料、公权力信息,对个人信息进行了定义。同时借鉴了美国、日本及西欧对于个人信息的不同保护模式,进而论证我国公民个人信息安全保护状况,对我国信息保护制度进行简要介绍,并指出公民信息保护权利意识的不足,会制约制度作用的发挥。第二部分从多角度审视我国公民个人信息保护制度。笔者分别从公民权利、社会秩序、公共安全视野及权利平衡视野下对公民个人信息安全进行分析。个人信息的保护是人格尊严的内在要求。每一个人都不愿做“透明人”,因此保护个人信息安全是公民人格尊严的内容。个人信息安全与人身安全、财产安全密切相关。个人信息安全对于社会秩序稳定及公共安全保障同样起着至关重要的作用。保护个人信息面临诸多权利冲突,如个人信息安全与公民知情权的冲突,个人信息安全与公民言论自由的冲突。这些冲突我们需要运用权利平衡的方法予以调和。权利平衡的方法其实就是使用权利位阶的方法进行利益衡量,从而得出某一权利优先于另一权利得到保护。第三部分论述了我国公民个人信息保护制度的问题,现阶段我国不同地域、不同行业对于个人信息保护的价值取向并不统一。构建完善个人信息保护制度必须厘清价值取向。价值取向是制度存在的基础,价值取向的统一是构建完善我国个人信息保护制度的前提。同时我国个人信息保护制度对于价值冲突协调不足。我国目前对于个人信息保护尚未出台统一单行法,法制的不健全制约公民个人信息保护工作的开展。同时法律规范为行业规范提供参照依据,法律规范的欠缺影响到了行业规范的发展。目前我国个人信息保护亟需完善法律规范和行业规范。第四部分论述我国公民个人信息保护制度的完善路径。笔者认为安全、正义及自由价值是我国个人信息保护制度的正确价值取向。不同的价值取向代表了个人信息保护制度所要衡量的不同社会需求,价值间的冲突在所难免,我们必须运用价值平衡的方法削弱价值冲突,最优化的保护个人信息安全。颁布《个人信息安全保护法》是全面综合保护个人信息的重要举措,为了适应我国社会经济的发展,当前我国已经具备了制定单行个人信息安全保护法的社会条件,制定颁布个人信息保护法是时代的需要,由于目前我国尚未出台个人信息保护法,所以很多侵犯个人信息安全及其他连带的社会问题并未能够彻底予以解决。当然并非颁布实施《个人信息安全保护法》,所有问题就能迎刃而解。我们必须积极完善行业自律规范,行业规范可以发挥专业优势,在各自领域构建符合行业特征的个人信息保护规范。行业规范的发展将为立法提供参考及借鉴,相比立法,行业规范的便捷性亦能及时适应社会的发展。总而言之,本文是从法理学角度研究构建完善我国个人信息保护制度,笔者从公民权利、社会秩序与公共安全及权利平衡角度分析论证个人信息安全的重要性,明确制定完善个人信息保护制度的原因。之后从价值取向、法律规范及行业规范上分析制度存在的问题,提出完善策略。希望通过本文的写作可以为我国个人信息保护制度的研究提供一些借鉴。
[Abstract]:The security problem in today's personal information has become a social hot spot in recent years, China's theoretical circles and there are different degrees of this problem is studied, the practice department also introduced a number of regulatory documents. However, different research and Discussion on this issue, the different departments in the field, scholars and practitioners are each from the field, the Department of view, not to sweep down irresistibly from a commanding height of personal information protection of our country launched a comprehensive study. Therefore, the author from the perspective of jurisprudence, using literature research, value analysis method, the comparative research on the concept of personal information, multi angle analysis of personal information protection system, points out the existing personal information protection system in China, and explore ways to improve the construction of personal information protection system in China. This thesis is composed of preface, text, epilogue, the text is divided into four parts. One part discusses the current situation of the concept of personal information and personal information protection system in China. These conflicts we need to be using the method of balance of power harmonic. Methods the right balance is actually using the rank of rights of the interests of the measure, thus obtains a right of priority in the other rights are protected. The third part discusses China's personal information protection system, at the present stage in China, different regions, different industry value orientation for the protection of personal information is not unified. To perfect the construction of personal information protection system We must clarify the value orientation. The value orientation is the basis of the existing system, the unity of value orientation is the premise to perfect the construction of personal information protection system in China. At the same time, the personal information protection system in China, the value of conflict for the lack of coordination. At present in our country for the protection of personal information has not yet issued a unified law, imperfect legal system restricts the protection of personal information to carry out the work. At the same time, legal norms for the industry standard reference, the lack of legal standards to the development of industry standards for the protection of personal information. The urgent need to improve our legal norms and industry standards. The fourth part discusses the path to improve our citizens' personal information protection system. The author thinks that the value of security, justice and freedom are correct the value orientation of the personal information protection system in our country. In a word, this paper is to construct the research from the angle of improving the personal information protection system in our country, the author from the civil rights, social order and balance point of public security analysis of the importance of safety evaluation and the right of personal information, to make clear the reasons to establish and perfect the personal information protection system. From the value orientation, existing legal norms and industry norms analysis system, put forward the perfect strategy. Hoping this paper can provide some reference for the study of personal information protection system in China.
