【摘要】：本文围绕着男女两性在婚姻家庭生活中和谐平衡这一核心理念,在以往研究的基础上,深入探讨了我国生育保险中的男性权益。文章在绪论中进行了文献综述,综合分析了我国现存关于生育保险中男性权益的研究状况,并提出借鉴之处与深入研究的方向与方法。鉴于目前该方向研究成果较少,作者首先详细阐明了研究这一问题的理论与实践意义。在文章的第三部分,作者从理论入手,阐述了生育保险中男性权益的哲学、社会学、伦理学、法学等基础。继而从理论回归实践,通过总结我国中央层面及各省、自治区、直辖市和副省级城市的相关规定,分析我国目前生育保险制度的现状及问题。然后介绍国外生育保险中男性权益的相关制度。接着思考我国建立这一制度的可行性,最后水到渠成地落脚到对生育保险制度的设计。本文从理论出发,落脚于制度,既不遵从“男主外,女主内”的传统观念,也摒弃了女权主义单纯从女性自由与权利角度出发之观点,而是希望通过生育保险的制度设计,实现男女两性在生育和家庭中权利义务的平衡,从而致力于促进家庭的和谐。
[Abstract]:This paper focuses on the core idea of harmonious balance between men and women in marriage and family life. On the basis of previous studies, this paper deeply discusses the male rights and interests in China's birth insurance. Comprehensive analysis of the existing situation of research on male rights and interests in maternity insurance in China, and put forward the reference and in-depth research direction and methods. In view of the current research results in this direction is less. In the third part of the article, the author starts with the theory, and expounds the philosophy, sociology and ethics of male rights and interests in maternity insurance. Then from the theory to practice, through summing up the central level of our country and the provinces, autonomous regions, municipalities and sub-provincial cities related provisions. This paper analyzes the present situation and problems of China's current birth insurance system, then introduces the related systems of male rights and interests in foreign maternity insurance, and then thinks about the feasibility of establishing this system in our country. Finally, the design of the birth insurance system. This article from the theory, settled in the system, neither comply with the traditional concept of "male owner, female master inside". It also abandons the feminist view from the angle of women's freedom and rights, but hopes to achieve the balance of rights and obligations between men and women in the birth and family through the system design of birth insurance.
