【摘要】：地理标志权作为与农业发展息息相关的知识产权类型,对于我国这样的农业大国来说,它的重要性是不言而喻的,正因为如此,农产品地理标志的保护也越发受到各级政府的重视。陕西省拥有大量的农产品地理标志资源,其主要集中在水果、茶叶、花椒以及中药材方面。为了大力发展陕西省的农业经济,促使陕西省农产品走上更广阔的市场领域,保护农产品地理标志就成为最有效的手段之一。然而,由于我国对地理标志保护的起步时间较晚,迄今为止仍存在很多的立法冲突和制度缺陷,这无疑在很大程度上阻碍了地理标志产品的发展。加之,陕西省地处我国西部,公众对于知识产权的保护意识相对较弱,因此便造成了政府部门一方在大力推动地理标志产品的注册,但企业一方却不愿意申请使用相应地理标志的尴尬局面,更有部分生产经营者投机取巧,假冒、伪造地理标志产品并以超高价销售,久而久之,便失去了消费者对地理标志产品的信赖。故而,为了更好更高效的保护和发展陕西省农产品地理标志,就需要从陕西省的实际情况出发,制定合理的发展目标和规划,对发展中遇到的问题和困难进行拆解和分析,在借鉴国内外关于地理标志保护先进经验的基础上,具体包括法律规定、制度设计、监管体系及其他措施等各个方面,促使陕西省地理标志产品的发展展开新局面、迈上新台阶。
[Abstract]:As a type of intellectual property which is closely related to the development of agriculture, the right of geographical indication is of great importance to a large agricultural country such as China, which is precisely because of this. The protection of geographical indications of agricultural products has been paid more and more attention by the governments at all levels. Shaanxi Province has a large number of geographical indications of agricultural resources, mainly concentrated in fruit, tea. In order to develop the agricultural economy of Shaanxi Province and promote the agricultural products of Shaanxi Province to enter the broader market field, the protection of geographical indications of agricultural products has become one of the most effective means. Due to the late start of the protection of geographical indications in our country, there are still many legislative conflicts and system defects so far, which undoubtedly hinders the development of geographical indication products to a great extent. Shaanxi Province is located in the west of China, the public awareness of intellectual property protection is relatively weak, so the government department is vigorously promoting the registration of geographical indication products. However, the enterprise side is unwilling to apply for the awkward situation of using the corresponding geographical indications, and some of the producers and operators are more opportunistic, counterfeit, counterfeit and sold at high prices. Therefore, in order to better and more efficient protection and development of geographical indications of agricultural products in Shaanxi Province, we need to proceed from the actual situation of Shaanxi Province. To formulate reasonable development goals and plans, to disassemble and analyze the problems and difficulties encountered in the development, on the basis of drawing lessons from the advanced experience in the protection of geographical indications at home and abroad, including the specific legal provisions and system design. Supervision system and other measures promote the development of geographical indication products in Shaanxi Province to a new stage.
