【摘要】：随着世界贸易的发展,我国的著作权案件不断上升,从跨行业到跨国界,案件类型层出不穷,给公安机关侦办该类案件带来了极大的挑战。传统的侦查方式已经不能满足当前侦办著作权犯罪新形式,因此有必要在传统的侦查方式基础上探索新的侦查模式,更新侦查理念,打造专业队伍。本文第一部分从理论的角度对侵犯著作权犯罪侦查的基本概念进行了界定,阐述侵犯著作权犯罪的发生原因,分析该种犯罪行为带来的社会危害性,并以各个角度的犯罪特点来全面呈现当前侵犯著作权犯罪的形态。阐述了侵犯著作权犯罪侦查的定义和具体侦查应遵循的原则。同时与其他著作权刑事保护开展较好的几个国家进行比较,为下文打好理论基础。第二部分分析当前侵犯著作权犯罪侦查现状。笔者以宁波全大市为例,运用实际案件数据和对比图表说明当前著作权犯罪立破案的基本情况,并具体阐述了当前侦办著作权案件的过程,由此我们看到公安机关对著作权犯罪的打击力度远没有达到理想的程度。第三部分提出了侦查过程中存在的不足,结合内部与外部原因,深入分析存在的几个问题,如当前侦查机制现状、专业队伍不健全,收集证据难,网络侦办侵犯著作权犯罪案件困难等。第四部分提出相应的侦查建议,如强化证据收集意识、健全著作权协作机制、加强与被侵权对象沟通等等。其中以提出网络侵犯著作权犯罪侦查建议为重点。
[Abstract]:With the development of world trade, the copyright cases in our country are on the rise, from cross-industry to cross-border, the types of cases emerge in endlessly. It brings great challenge to the public security organ to investigate this kind of case. The traditional investigation method can not satisfy the new form of investigating copyright crime at present. Therefore, it is necessary to explore the new investigation mode and renew the investigation idea on the basis of the traditional investigation mode. The first part of this paper defines the basic concept of criminal investigation of infringement of copyright from the theoretical point of view, and expounds the causes of the crime of infringement of copyright. The social harmfulness brought by this kind of criminal behavior is analyzed. The definition of criminal investigation of copyright infringement and the principles to be followed in specific investigation are expounded. Meanwhile, the criminal protection of copyright is carried out with other criminal protection of copyright. The better countries compare. The second part analyzes the current situation of criminal investigation of copyright infringement. The author takes Ningbo as an example. Using the actual case data and comparative charts to illustrate the current copyright crime of the basic situation of the case, and specifically described the current process of investigating copyright cases. From this we can see that the intensity of public security organs to attack copyright crime is far from the ideal degree. The third part puts forward the shortcomings in the investigation process, combining internal and external reasons. Deeply analyze the existing several problems, such as the current situation of investigation mechanism, professional team is not perfect, the collection of evidence is difficult, network investigation of copyright infringement cases difficult. 4th part of the corresponding investigation suggestions. Such as strengthening the consciousness of collecting evidence, perfecting the cooperation mechanism of copyright, strengthening communication with the target of infringement and so on.
