《民法总则》“知识产权条款”的评析与展望

【摘要】：我国《民法总则》已于2017年3月15日通过。该法涉及知识产权制度方面的规定仅一条。由于知识产权属于民事权利和无形财产权,并且随着经济社会发展其地位日益重要,未来在《民法总则》修订中需要对知识产权制度设立专节规定。针对知识产权制度的规定,需要在知识产权的定义、知识产权的范围和内容、知识产权取得和行使原则、知识产权限制等方面进行补充与完善。
[Abstract]:The General principles of Civil Law in China were adopted in March 15th 2017. The law deals with only one article of the intellectual property system. Because intellectual property rights belong to civil rights and intangible property rights. And with the economic and social development its status is becoming increasingly important in the future in the revision of the General principles of Civil Law there is a need to set up a special section of the intellectual property system and the provisions of the intellectual property system need to be defined in the intellectual property rights. The scope and content of intellectual property, the principle of acquisition and exercise of intellectual property, and the limitation of intellectual property are supplemented and perfected.
