我国保险消费者权益保护法律研究

【摘要】:早期海商保险发展至今,保险早已走入了寻常百姓的家门,保险的普及是人们生活水平提高的又一重要标志,也是人们追求高质量生活状态的体现。由于保险产品自身的特殊性和交易双方主体的地位差异等原因,人们在购买保险产品或理赔过程中很容易受到不同程度的侵害,所以在法律制定和监管模式的选择上,都在关注如何有效的保护投保人、被保险人及受益人的合法权益,即保险消费者的权益保护问题。“保险消费者”这一概念已经频繁的出现在广播媒体和监管部门的发文中,社会各界都已经引起的广泛的关注。2009年的《保险法》无疑的强化了保险消费者的权益保护工作,但是结合我国的保险业发展现状而言仍有必要进一步完善和发展。本文分成四个部分:第一部分从两个方面整体概述了保险消费者的权益,首先对保险消费者进行界定,其次分析保险消费者的基本权利及其基础理论。第二部分分别介绍了英国、美国、日本三个国家的法律法规及监管方面的举措。立足于我国国情,吸收借鉴先进的理念制度,是我国尽快发展完善保险消费者保护体系的重要途径。第三部分较为详细的介绍了我国保险消费者权益保护的现状,其中分别从立法方面、监管方面以及受侵害的现状进行论述,一一阐述了我国保险消费者权益保护工作各方面的不足,同时强调了进一步加强保护的必要性。第四部分具体的阐述了如何完善我国保险消费者权益保护的相关法律和监管制度。此部分与前文是相对应的,也是从三方面同时进行完善,即立法方面完善、监管举措上完善以及针对具体侵害现状的完善。其中针对侵害现状的具体完善又可细化为五个方面,一是规范劝诱的方式和限度,确立适宜性原则和推销广告客观性原则。二是信用评级制度引入保险行业,为保险消费者提供可靠的消费者参考。三是建立独立的仲裁机构与救济制度,为保险纠纷提供多元化的解决途径。四是深入对保险消费者的维权意识教育,以此提高保险消费者的维权意识和维权能力。五是完善保险行业自律组织的行业监管,做到自律组织、监管部门与保险行业的整体化发展。
[Abstract]:With the development of the early merchant insurance, insurance has already entered the homes of ordinary people. The popularization of insurance is another important sign of the improvement of people's living standard. It is also the embodiment of people's pursuit of high quality of life, because of the particularity of insurance products themselves and the difference of the status of both parties. People in the process of purchasing insurance products or claims are vulnerable to varying degrees of infringement, so in the law formulation and regulatory model choice, they are concerned about how to effectively protect policy holders. The legal rights and interests of the insured and the beneficiary, that is, the protection of the rights and interests of the insurance consumers, the concept of "insurance consumers" has frequently appeared in the broadcast media and regulatory departments. The insurance law of 2009 undoubtedly strengthened the protection of the rights and interests of insurance consumers. However, it is necessary to further improve and develop the insurance industry. This paper is divided into four parts: the first part summarizes the rights and interests of insurance consumers from two aspects. First of all, insurance consumers are defined, then the basic rights of insurance consumers and their basic theories are analyzed. The second part introduces the United Kingdom and the United States respectively. Japan's laws, regulations and regulatory measures. Based on the national conditions of our country, absorb and learn from the advanced concept system. It is an important way for our country to develop and perfect the insurance consumer protection system as soon as possible. The third part introduces the current situation of the insurance consumer rights and interests protection in detail in our country, which respectively from the legislative aspect. Supervision and the current situation of infringement are discussed, one by one elaborated on the protection of the rights and interests of insurance consumers in all aspects of the deficiencies. At the same time, it emphasizes the necessity of further strengthening the protection. Part 4th describes how to improve the relevant laws and regulatory system of the protection of the rights and interests of insurance consumers in China. This part is corresponding to the previous part. Is also from three aspects of the improvement, that is, legislation, regulatory measures to improve and improve the status of specific violations of the specific improvement, which can be refined into five aspects of the specific status quo. The first is to standardize the ways and limits of persuasion, to establish the principle of suitability and the objective principle of advertising, and the second is to introduce the credit rating system into the insurance industry. The third is to establish an independent arbitration institution and relief system, to provide a diversified solution to insurance disputes. Fourth, in-depth awareness of the awareness of insurance consumers education. Fifth, improve the insurance industry self-regulatory organization industry supervision, achieve self-regulatory organizations, regulatory authorities and insurance industry integrated development.
