电子商务中消费者个人信息的民法保护

【摘要】：随着电脑的普及和互联网的迅速发展使得人类进入了信息时代,其中信息产业中的佼佼者——电子商务业给传统商业带来极大的机遇和挑战。随着电子商务业的兴起,消费者个人信息成为其最宝贵的资源之一,但我国目前对其保护的相关立法却寥寥无几,因此在法律层面我国应当加强对其保护。本文从电子商务消费者个人信息的基本理论问题出发,在考察世界其他国家和地区立法例和分析我国保护现状的基础上,提出适合我国基本国情的立法建议。本文除前言、结语外,正文分为四个部分:第一部分,电子商务中消费者个人信息。在提出电子商务中消费者个人信息定义的基础上着重分析其两个属性,即不仅具有人格属性而且兼具财产属性,同时从其产生来源角度出发对其进行了分类,最后论述了对其进行法律保护的必要性和重要性。第二部分,我国对其民法保护现状及不足,通过审视我国对电子商务中消费者个人信息保护法律现状,分析目前在立法和司法上的不足。第三部分,国外对其法律保护的现状及评价,着重介绍了经济合作组织、欧盟及美国的相关模式,通过比较法分析,为我国形成自己的立法保护模式提供经验。第四部分,完善对电子商务消费者个人信息民法保护的建议,此部分为本文的重点,本文在第二部分探究我国存在的问题和第三部分分析国外经验的前提下上,提出适合我国的立法和司法的建议。
[Abstract]:With the popularity of computers and the rapid development of the Internet, mankind has entered the information age. One of the best in the information industry-e-commerce brings great opportunities and challenges to the traditional business. With the rise of e-commerce, consumer personal information has become one of its most valuable resources. However, there are very few relevant legislation in our country at present, so we should strengthen the protection in the legal level. This paper starts from the basic theory of personal information of e-commerce consumers. On the basis of investigating the legislation examples of other countries and regions in the world and analyzing the present situation of protection in our country, the author puts forward some legislative suggestions suitable for the basic national conditions of our country. Besides the foreword and conclusion, the text is divided into four parts: the first part. On the basis of putting forward the definition of consumer personal information in electronic commerce, this paper focuses on the analysis of its two attributes, that is, not only the personality attribute but also the property attribute. At the same time, the author classifies it from the angle of its origin, and finally discusses the necessity and importance of its legal protection. The second part, the current situation and deficiency of civil law protection in our country. By examining the current legal situation of consumer personal information protection in electronic commerce in our country, this paper analyzes the deficiency in legislation and judicature at present. The third part, the current situation and evaluation of the legal protection in foreign countries. This paper mainly introduces the relevant models of the Economic Cooperation Organization, the European Union and the United States. Through the comparative analysis, it provides the experience for our country to form its own legislative protection model. Part 4th. This part is the focus of this paper. The second part explores the existing problems in China and the third part analyzes the foreign experience on the premise. Put forward suitable legislation and judicial suggestion of our country.
