比较法视野下的后位继承研究

【摘要】：后位继承是指在遗嘱继承中,因某种条件的成就或期限的到来,被继承人的财产利益按序分配给不同顺位的继承人的制度。该制度实现了资源的最优配置,既发挥了物之用益权,又保障了物之所有权,已为各国民事立法所认可。对比研究表明,德国、瑞士等国在继承层数、主体、条件以及权利救济等方面立法完善,我国应借鉴国际先进立法经验,结合国情创建后位继承制度。
[Abstract]:Successor succession refers to the system in which the property interests of the heirs are assigned to the heirs in order because of the achievement of certain conditions or the arrival of the term in succession. This system realizes the optimal allocation of resources. It has been recognized by the civil legislation of various countries. The comparative study shows that Germany, Switzerland and other countries are in the number of layers of inheritance, subject. Our country should draw lessons from the international advanced legislative experience and establish the successor inheritance system according to the national conditions.
