共有人和承租人优先购买权的冲突与协调

【摘要】:我国民事法律制度中的共有人优先购买权和承租人优先购买权有其独特的法律价值和立法意义,但我国目前相关法律对这两种优先购买权的规定均较为笼统和分散。这便导致了在司法实践中遇到此类诉讼时缺乏可操作性,尤其是对两者有无发生冲突的可能,以及若发生冲突应如何协调并未做任何立法规定,从而针对此类问题在理论界产生了激烈讨论,且司法实践中也因对此类问题没有明确规定而导致当事人合法权益无法得到保证。因此,本人尝试通过对共有人优先购买权和承租人优先购买权的概述、国内外关于两者的相关立法、两者有无发生冲突的可能,以及两者若发生冲突我们应如何协调等一系列问题的论述,继而从有效协调两者冲突的立法建议等方面提出如何通过借鉴国外相关先进立法,最终使我国共有人优先购买权和承租人优先购买权制度日臻完善。本文的结构除引言和结语,共分为五个部分,即:第一部分是概括论述优先购买权的一般理论。第二部分是对共有人优先购买权以及包括我国在内的诸多国家,对共有人优先购买权的相关立法逐一进行深入而全面的探究,从而为我国共有人优先购买权制度的优化与改进提供科学参考。第三部分是对承租人优先购买权及其他相关房屋主体优先购买权之间所存在的冲突、其他国家对承租人优先购买权的相关立法进行分析和研究,以便为进一步完善我国承租人优先购买权制度提供一定借鉴。第四部分是对共有人优先购买权和承租人优先购买权是否会发生冲突,以及若发生冲突应如何协调进行论述。第五部分是对全文进行总结,并合理参考其他国家相关的科学而合理的立法机制,从而为我国改进和优化共有人优先购买权制度和承租人优先购买权制度提供合理而有效的立法建议。
[Abstract]:China's civil legal system of the co owner and lessee preemption has its unique legal value and legal significance, but China's current laws related to these two kinds of preemption provisions are more general and scattered. This led to such litigation in judicial practice and lack operation, especially for the two are in conflict, and how to coordinate the conflict did not make any legislation, thus to solve these problems in theoretical circles have a heated discussion, and also in the judicial practice because there is no clear regulations on such problems of the legitimate rights and interests of the parties can not be guaranteed. Therefore, I try to based on the total summary of pre emptive rights and the right of preemption of lessee, the relevant legislation of both at home and abroad, there is no conflict between the two, and in the event of conflict I They should be a series of problems such as how to coordinate the discussion, then present how to learn foreign advanced legislation from the effective coordination of the conflict between the legislative proposals, eventually make China owner and lessee preemption system is being perfected. The structure of this addition to the introduction and conclusion, is divided into five part: the first part is the general theory summarizes the priority purchase right. The second part is the co owner and many countries including China, the common legislative priority to purchase one by one into the deep and comprehensive research, provide scientific reference for optimization and improvement to our country a preemptive right system. The third part is on the right of preemption of lessee and other related housing the main purchasing priority conflict between the existence of other countries, the lessee's purchasing priority Analysis and Research on the related legislation, in order to further improve China's preemptive right system to provide certain reference. The fourth part is the co owner and lessee preemption would conflict, and the conflict should be how to coordinate the theory. The fifth part is a summary of the full text, and reasonable reference to other relevant national scientific and reasonable legislative mechanism, so as to improve and optimize our country there are legislative proposals of preemption system and the lessee preemption system to provide a reasonable and effective.
