农村留守妇女权益法律保障研究

【摘要】：80年代以来,社会飞速的进步,随着城市化、工业化进程的推进,大量的农村剩余劳动力涌入城市发展,所谓的“农村留守妇女”随之出现,这是随着农村的外出务工人员增多而出现的一个目前社会主义新农村建设中一群非常重要但被遗忘的特殊群体。而且这个新的群体还在不断的扩大,并将长期存在于中国现今的社会。由于城乡发展的二元差异,传统的封建观念思想的影响,农村司法权力保护不足等原因,导致了在丈夫外出打工后,留守妇女们承担着农业生产、赡养老人、照顾孩子的重担,又在做出这些牺牲的同时,合法权益不同程度的遭受着迫害。她们超负荷的家务劳动与精神压力,男女不平等的经济地位与政治地位,单薄的法律意识与贫瘠的文化生活,各方面因素造成了她们的财产权益、政治权益、文化教育权益、婚姻家庭权益以及社会保障权益等得不到应有的保障,而我们现在的社会缺少对这些留守妇女的关心和关注。留守妇女现象给社会带来了一系列不和谐因素,她们严峻的生存状况不容忽视,她们的生存质量直接关系和谐社会的建立。社会主义新农村建设就是要建设和谐社会、和谐农村以及和谐家庭。农村留守妇女在新农村建设中作用已日益凸显,但由于诸多因素的限制,留守妇女们的力量还没有得到充分的发挥,如何挖掘农村留守妇女更大的潜力,解除农村留守妇女面临的诸多困境,保障留守妇女的合法权益,不仅是构建和谐社会需要解决的新课题,也是关系到新农村经济社会发展的全局,理应成为当今社会各界需要引起关注的一个重要问题。因此对农村留守妇女问题的研究,特别是合法权益的保障问题的研究,具有非常现实而又深远的意义。现阶段我国的农村留守妇女的合法权益保障并不乐观,仍需要法律法规不断的完善和修订,才能切实的贯彻实施。本文旨在从法学的视角考虑,研究方法并借鉴成功的研究经验,分析留守妇女权益受损的现状与突出问题,找出留守妇女权益受损的主要根源,从而从法律法规方面提出一些解决方案,对完善留守妇女相关法律法规方面加以重视,为农村留守妇女们构建一个广泛而强大的法制社会支持网络,这对于保障留守妇女合法权益,建设社会主义新农村,稳定农村社会,都有着举足轻重的作用。
[Abstract]:Since 80s, with the rapid progress of society, with the development of urbanization and industrialization, a large number of rural surplus labor force has poured into the urban development, and the so-called "rural women left behind" has appeared. This is a very important but forgotten special group in the construction of a new socialist countryside as the number of migrant workers in the countryside increases. And this new group is still expanding. Because of the dualistic difference between urban and rural development, the influence of traditional feudal ideas, and the inadequate protection of judicial power in rural areas, this has resulted in the husband going out to work for a job. Women left behind bear the burden of agricultural production, support the elderly, take care of their children, and while making these sacrifices, their legitimate rights and interests are being persecuted to varying degrees. They are overburdened with domestic work and mental pressure. The unequal economic and political status of men and women, weak legal consciousness and poor cultural life have resulted in their property rights and interests, political rights and interests, cultural and educational rights and interests. The rights and interests of marriage and family as well as the rights and interests of social security are not properly protected, but our society now lacks concern and concern for these left-behind women. The phenomenon of left-behind women has brought a series of disharmonious factors to the society. Their grim living conditions cannot be ignored. Their quality of life is directly related to the establishment of a harmonious society. The construction of a new socialist countryside is to build a harmonious society. Harmonious countryside and harmonious family. The role of rural left-behind women in the construction of new countryside has become increasingly prominent, but due to the constraints of many factors, the strength of left-behind women has not been given full play. How to tap the greater potential of rural left-behind women, remove the many difficulties that rural left-behind women face, and protect the legitimate rights and interests of left-behind women is not only a new problem to be solved in building a harmonious society. It is also the overall situation related to the economic and social development of the new rural areas, and should become an important issue that needs attention from all walks of life. Therefore, the study on the issue of rural women left behind, especially the question of the protection of legitimate rights and interests, At present, the legal rights and interests of the rural women left behind in our country are not optimistic. We still need to perfect and revise the laws and regulations continuously, in order to carry out the actual implementation. The purpose of this article is to consider from the perspective of law. The research method and the successful research experience are used to analyze the present situation and prominent problems of the rights and interests of the women left behind, to find out the main causes of the rights and interests of the women left behind, and to put forward some solutions from the aspects of laws and regulations. We should pay attention to the improvement of laws and regulations relating to women left behind, and build a broad and strong social support network of legal system for rural women who stay behind. This will help safeguard the legitimate rights and interests of women left behind and build a new socialist countryside. Stable rural society, have a pivotal role.
