论网络著作权侵权损害赔偿的认定

【摘要】：在互联网迅猛发展的大环境下,网络著作权侵权成本低,侵权行为频发,软件、影音、出版等行业正成为著作权侵权行为最猖獗的领域。囿于网络隐蔽性强,侵权行为不易发现,维权成本高、诉讼道路艰辛以及判赔金额低等一系列因素,著作权人并不乐于积极进行维护自己利益的行动,客观上又助长了侵权人的侥幸心理,促使侵权行为频发。建立、健全我国网络著作权保护制度,特别是完善网络著作权侵权损害赔偿制度,有望为在司法实践的过程中圆满处理网络著作权侵权纠纷提供强有力的法律依据。真正意义的权利,应表现为在被侵犯后所能获得的救济程度,网络著作权侵权损害赔偿应被视为网络著作权法律保护制度的核心内容。当前形势下,为解侵犯网络著作权行为频繁发生的燃眉之急,同时也为完善我国著作权保护的法律体系,应对网络著作权侵权损害赔偿制度下的赔偿认定、赔偿原则、赔偿数额的确定等重大分歧问题进行深入细致的分析。通过对近年来网络著作权领域发生的重大案例进行分析,可以发现导致该领域侵权行为屡禁不止的最主要的因素就是我国现行的补偿性损害赔偿制度无法达到规制效果。笔者认为,不妨审慎借鉴国外惩罚性赔偿制度的立法司法经验,充分结合我国的国情,考虑我国的法治环境,在现行的法定赔偿制度的框架之内,通过严苛适用条件来构建惩罚性赔偿制度;同时在立法上完善网络环境下的著作权合理使用制度以及在司法上优化电子证据的保全方式等相关配套措施,以期实现合理维护著作权人、信息传播者以及社会公众三方面的利益平衡。
[Abstract]:With the rapid development of the Internet, the network copyright infringement is becoming the most rampant field because of its low cost, frequent infringement, software, audio and video, publishing and so on. Infringement is not easy to find, the cost of safeguarding rights is high, the road of litigation is difficult, and the amount of compensation is low. Copyright owners are not willing to take active action to safeguard their own interests, which objectively encourages the infringer's lucky psychology. To promote the frequent occurrence of infringing acts. To establish and improve our network copyright protection system, in particular, to perfect the network copyright infringement compensation system. It is expected to provide a strong legal basis for the successful handling of network copyright infringement disputes in the course of judicial practice. The real meaning of the right should be the degree of relief that can be obtained after being infringed. The compensation for network copyright infringement should be regarded as the core content of the legal protection system of network copyright. At the same time, in order to perfect the legal system of copyright protection in our country, we should recognize the compensation and the principle of compensation under the network copyright infringement compensation system. The determination of the amount of compensation and other major diverging issues are analyzed in depth and meticulous. Through the analysis of major cases in the field of network copyright in recent years, It can be found that the main factor leading to the repeated prohibition of tort in this field is that the current compensatory damages system in our country cannot achieve the regulatory effect. According to the situation of our country, considering the legal environment of our country, the punitive damages system is constructed through strict applicable conditions within the framework of the current legal compensation system. At the same time, in order to realize the reasonable protection of copyright owners, we should improve the system of the rational use of copyright in the network environment and optimize the preservation of electronic evidence in the judicial field.
