论日本专利间接侵权构成要件及其对我国的启示

【摘要】：我国在专利间接侵权制度的引入和具体规定上,多年来始终存在分歧和争议,直到最新司法解释和专利法第四次修改《修订草案(送审稿)》的发布。日本采用该项制度迄今已逾50年,对侵权判定中的物品、行为人主观意图、直接侵权等要件具备相对成熟的法律规定、丰富的司法经验和现实教训,对于我国有着一定借鉴意义。重点体现在:第一,我国在"非专用品型间接侵权"方面仍缺少规定,在未来立法中亟需补缺。一方面要充分认识"非专用品型"侵权物品的判定难度,另一方面应审慎参考日本模式中的主观要件;第二,警惕日本"专用品型"和"非专用品型"侵权的二元规定模式所导致的司法裁判中向"专用品型间接侵权"的逃逸;第三,有关直接侵权地位的"修正论"观点更加符合市场和利益平衡的需要,相比其他观点更加值得借鉴。
[Abstract]:Over the years, there have always been differences and disputes over the introduction and specific provisions of the system of indirect patent infringement in China. Up to the latest judicial interpretation and the publication of 4th revisions to the Patent Law, Japan has adopted this system for more than 50 years. Direct infringement and other elements have relatively mature legal provisions, rich judicial experience and practical lessons, which have certain reference significance for our country. The main points are as follows: first, there is still a lack of regulations on "indirect infringement of non-special products" in our country. On the one hand, we should fully understand the difficulty of judging the "non-exclusive goods" infringing goods, on the other hand, we should carefully refer to the subjective elements in the Japanese model; second, To guard against the escape of the "exclusive product indirect tort" caused by the dualistic prescriptive mode of "exclusive product type" and "non-exclusive product type" infringement in Japan; third, The "amendment theory" about the position of direct tort is more suitable for the needs of market and interest balance, and is more worthy of reference than other views.
