从我国广电实践重新审视广播组织权制度

【摘要】：对广播组织权现有的研究主要集中于制度起源、历史发展、国际比较、法理分析等视角,本文从我国广电行业相关工作实践出发,重新审视广播组织权的客体、内容和主体制度。广播组织权的客体是节目信号,而不是节目内容本身;节目内容本身的版权问题对广播组织权的行使不会产生影响。在我国现行立法中,广播组织权的内容仅有转播权、录制权以及对录制品的复制权三项,不足以有效保护广播组织,有必要加入信息网络传播权、向公众传播权、发行权。广播组织权的主体不包括网播组织。
[Abstract]:The existing research on the right of broadcasting organization mainly focuses on the origin of the system, historical development, international comparison, legal analysis and so on.
