论体育赛事直播节目的可版权化——以新浪诉天盈九州凤凰网直播中超案为引

【摘要】：我国体育产业的发展使人们越来越重视体育赛事直播节目的知识产权保护问题。体育赛事直播节目本身已具备作品所要求的独创性,通过邻接权并不能对其进行完满的保护。将体育赛事直播节目版权化不仅是因为其满足作品的属性并具有极大的经济和社会价值,而且只有通过版权保护才能为其提供一条较为完满的保护路径。前者是版权化的必要性,后者是版权化的可行性。版权化之后虽然保护范围扩大,但仍然存在法律适用的困境,目前可通过适用《著作权法》第10条的兜底条款予以解决。修改《著作权法》时应重构"广播权"和"信息网络传播权",以完善目前体育赛事直播节目的版权保护路径,规制日益猖獗的"盗播"行为。
[Abstract]:With the development of sports industry in China, people pay more and more attention to the protection of intellectual property rights of live sports events. The copyright of live sports programs is not only because they satisfy the properties of the works, but also because they have great economic and social value. The former is the necessity of copyright, and the latter is the feasibility of copyright. Although the scope of protection has been expanded, there is still a dilemma in the application of the law. At present, it can be solved by applying the bottom clause of Article 10 of the copyright Law. When amending the copyright Law, we should reconstruct the "broadcast right" and "the right of Information Network Transmission" in order to perfect the copyright protection path of the current live broadcast programs of sports events. Regulation of the increasingly rampant "theft" behavior.
