【摘要】：正一、问题的提出《中华人民共和国侵权责任法》(以下简称《侵权责任法》)第十九条规定:"侵害他人财产的,财产损失按照损失发生时的市场价格或者其他方式计算。"这是对财产权受侵害时承担赔偿损失责任的损失额计算方法的规定。这里所指的受侵害的财产权既包括有形财产的财产权,也包括无形财产的财产权,亦即既包括所有权及各种物权,也包括知识产权,甚至包括债权及其他财产权益。由于财产的形态多样,侵权形态多样,侵害财产
