民族传统艺术传承人的知识产权保护——基于《著作权法》框架下的分析

【摘要】：随着全球化时代的到来,少数民族传统艺术传承者面临着日益严峻的生存环境,亟待通过知识产权保护的方式来保护自身利益。我国《著作权法》主要是对艺术、舞蹈、文学书籍、音乐作品等相关作品权利保护的法律,在保护少数民族传统艺术传承人的知识产权方面也发挥着作用。然而,由于少数民族传统艺术的特殊性,《著作权法》在保护少数民族传统艺术传承人的知识产权方面依然存在一些短缺,有待于进一步完善相关立法。
[Abstract]:With the arrival of the globalization era, the traditional art inheritors of ethnic minorities are faced with an increasingly severe living environment, and it is urgent to protect their own interests through the way of intellectual property protection. Laws that protect the rights of literature, books, music and other related works also play a role in protecting the intellectual property rights of traditional art inheritors of ethnic minorities. Because of the particularity of minority traditional art, the copyright Law still has some shortages in protecting the intellectual property rights of minority traditional art inheritors.
