【摘要】：温州20年住宅建设用地使用权到期该如何续期的事件,再度引发社会高度关注,对建设用地使用权续期制度的相关探讨成为学界研究的热点。针对近期温州发生的住宅用地到期事件,并结合青岛、深圳发生的同类建设用地到期事件,阐析我国建设用地使用权续期制度的现行法律规定,剖析其存在的冲突,提出协调的规则,厘清我国建设用地使用权续期制度在法律层面的具体规定。结合各地的具体做法,指出我国建设用地使用权续期制度存在两大主要问题:即住宅建设用地使用权期满“自动续期”规定的模糊性;非住宅建设用地使用权期满续期的实体和程序规定缺失,未续期时地上建筑物归属的规定有失公允。针对我国建设用地使用权续期制度存在的问题,对其立法路径进行探索,提出我国建设用地使用权续期制度应遵循的基本原则;同时借鉴其他国家和地区相关制度的有益经验,确立住宅建设用地附条件有偿自动续期模式,并尝试构建带免额续期面积的超额累进式续费方案;明确非住宅建设用地有偿申请续期模式,合理确定续期期限和次数,制定合理的续费标准,并妥善处理期满地上建筑物的归属问题,为完善我国住宅与非住宅建设用地使用权续期制度提供参考。
[Abstract]:The issue of how to renew the right to use residential construction land in Wenzhou for 20 years has once again aroused high social concern. The relevant discussion on the renewal system of the right to use construction land has become a hot topic in academic circles. In view of the recent residential land expiration events in Wenzhou and the similar construction land expiration events in Qingdao and Shenzhen, This paper analyzes the current legal provisions of the renewal system of the right to use construction land in China, analyzes its conflicts, puts forward the coordinated rules, and clarifies the specific provisions of the renewal system of the right to use construction land in our country at the legal level. It is pointed out that there are two main problems in the renewal system of the right to use construction land in China: the ambiguity of the "automatic renewal" of the term of the right to use residential construction land, the absence of substantive and procedural provisions for the renewal of the right to use non-residential construction land at the expiration of the term. In view of the problems existing in the renewal system of the right to use construction land in our country, the legislative path is explored, and the basic principles to be followed in the renewal system of the right to use construction land in our country are put forward. At the same time, using the beneficial experiences of other countries and regions for reference, the paper establishes the model of automatic renewal of residential construction land with conditional compensation, and tries to build a scheme of excess progressive renewal with waived area of renewal. It is clear that the mode of renewal of non-residential construction land is paid, the period and times of renewal are reasonably determined, the reasonable standard of renewal fee is worked out, and the problem of ownership of buildings on the ground at the expiration of the period of time is properly dealt with. It provides reference for perfecting the renewal system of residential and non-residential construction land use right in our country.
