特殊群体的隐私权保护——以社会工作介入艾滋病防治为视角

【摘要】：艾滋病的防治不仅是医学上的问题,也是人类面临的重大社会问题,同时也给法学界带来了诸多问题的思考。社会工作介入艾滋病的防治并与医疗方法想结合,对艾滋病的防治工作具有积极意义。但在社会工作介入艾滋病防治的工作中,艾滋病患者的隐私权与大众知情权的冲突问题不可避免。本文拟从社会工作介入艾滋病防治为视角,通过分析艾滋病患者的基本人权,结合社会工作介入的实践困境,以法律的手段协调艾滋病人隐私权与大众知情权之间的关系,以期有利于艾滋病人隐私权的保护,推动我国艾滋病防治工作的发展。
[Abstract]:The prevention and treatment of AIDS is not only a medical problem, but also a major social problem facing mankind. At the same time, it has brought a lot of problems to the legal community. Social work is involved in the prevention and treatment of AIDS and wants to be combined with medical methods. It is of positive significance to the prevention and treatment of AIDS. However, in the process of social work getting involved in the prevention and treatment of AIDS, The conflict between the right to privacy of AIDS patients and the right to know is inevitable. From the perspective of social work intervention in the prevention and treatment of AIDS, this paper analyzes the basic human rights of AIDS patients and combines the practical dilemma of social work intervention. To coordinate the relationship between the right to privacy of AIDS patients and the right to know by means of law in order to benefit the protection of the right of privacy of AIDS patients and to promote the development of AIDS prevention and control work in China.
