【摘要】：近年来,精神病人伤人伤己事件频发,精神病人生活状况令人堪忧,基本人权无法得到保障,越来越多的精神病人伤人或被伤事件已经引起了社会的广泛关注,精神病人是一个潜伏的高危人群,同时也是弱势群体,由于监护监管力度的不够,社会对精神病人产生恐惧心理的同时,也忽视了对精神病人人权的保护。监护制度是精神病人制度的重要组成部分,我国的监护制度适用行为能力的宣告制度,对无民事行为能力人和限制民事行为能力人设立监护人,对于未成年的精神病人适用未成年人监护制度,对于成年精神病人适用成年人监护制度,随着精神病人数量的持续增长,我国精神病人监护制度的问题和弊端日益显现,我国对精神病人设立的监护制度比较简单化,没有公共监护制度。本文主要内容要包括目的、方法、结果和结论。本文主要立足我国的精神病人生存现状,分析我国现有精神病人监护制度的不足与缺陷,同时借鉴两大法系比较完善的成年人监护制度,如德国和英国的相关制度,为完善我国的精神病人监护制度提供些许参考建议。文章主要包括四部分内容：第一部分主要论述精神病人监护制度的基本理论,重点阐述了在医学中和法学中对精神病人的定义,精神病人监护制度的基本内容,包括我国关于精神病人监护的立法规定,意定监护制度和精神病人公共监护制度。第二部分介绍了国外关于精神病人监护制度的立法和理论研究,重点介绍了相对比较完备的德国和英国的相关制度,以及对我国精神病人监护制度立法和实践的借鉴和启示。第三部分主要阐述了我国现阶段精神病人监护制度的立法和司法实践的不足与缺陷,相比较德日、英美存在的问题以及面临的社会现实。第四部分主要是针对我国相关监护制度的问题提出的完善建议和考量,借鉴国外经验和制度,立足我国精神病人监护的现状,对其立法和司法实践提出个人的完善建议。
[Abstract]:In recent years, mental patients hurt themselves frequently, the living conditions of mental patients are worrying, the basic human rights can not be guaranteed, and more and more mental patients hurt or injured has aroused the widespread concern of the society. Mental patients are a latent high-risk group, but also a vulnerable group. Due to insufficient supervision and supervision, the society has a fear of the mentally ill at the same time. The guardianship system is an important part of the mental patient system. The guardianship system in our country is applicable to the declaration system of behavior capacity. The establishment of guardians for persons with no capacity for civil conduct and persons with limited capacity for civil conduct, the application of the system of guardianship of minors to the mental patients of minors, and the application of the system of guardianship of adults to the mental patients of adults, With the continuous growth of the number of mental patients, the problems and drawbacks of the mental patient guardianship system in our country are becoming increasingly apparent. The guardianship system of mental patients established in our country is relatively simple and there is no public guardianship system. The main content of this paper should include the purpose. Based on the living situation of mental patients in our country, this paper analyzes the deficiencies and defects of the present mental patient guardianship system in our country, and draws lessons from the more perfect adult guardianship system of the two major legal systems at the same time. For example, the related systems in Germany and Britain provide some reference and suggestions for perfecting the mental patient guardianship system in our country.
