论视听作品的二次获酬权

【摘要】:视听作品的二次获酬权制度,是指视听作品的主要创作人在基本报酬之外,获得后续的额外报酬的制度。视听作品的著作权完整地、原始地归属于制片者。二次获酬权不是创作人对视听作品的著作权,而是一项获得报酬的权利。设置该权利的目的在于鼓励创作,提高视听作品的艺术水平。二次获酬权主体只能是创作团队中的主要人员,即编剧、专门为视听作品创作的音乐作品的作者、动画片的美术作品创作人、总导演、摄影师、主要演员等。二次获酬的计算标准只能以达到预期收益来界定。达到预期收益以后,得到的所有利润,都要从中计算二次获酬的费用。二次获酬权应当由立法确定,但具体的计算和支付方式,应当由当事人之间约定。行业协会和著作权集体管理组织之间可以协商形成标准合同文本,供当事人订立合同时选用。

The subject of the right to secondary remuneration can only be the main personnel of the creative team, namely, the writers, the authors of musical works specially created for audiovisual works, the creators of the art works of cartoons, the chief directors, the photographers, The criteria for calculating the secondary remuneration of the main actor, etc., can only be defined by achieving the expected income. After the expected income is achieved, all profits obtained must be calculated from the cost of the secondary remuneration. The right to secondary remuneration should be determined by legislation. However, the specific calculation and payment methods should be agreed between the parties. Trade associations and copyright collective management organizations may negotiate to form a standard contract text for the parties to choose when concluding a contract.
