论建设用地分层利用制度之理论与实践基础

【摘要】：土地的分层利用趋势对传统物权理论提出了挑战,物权理论之扩张为解决土地分层利用问题提供了理论上之可能性。建设用地分层利用制度适应了土地从平面向立体发展的历史需求,在建设用地分层利用条件下,各分层空间范围因具备经济价值和收益可能而可以成为独立的物权客体。因此,建设用地分层利用制度已具备一定的理论和实践基础,可以在立法上予以科学、系统设计。
[Abstract]:The trend of stratified use of land challenges the traditional theory of real right. The expansion of the theory of real right provides a theoretical possibility for solving the problem of land stratification. The system of stratified use of construction land adapts to the historical demand of land development from plane to three-dimensional, and under the condition of stratified utilization of construction land, Each stratified space scope can become an independent object of real right because of its economic value and income. Therefore, the system of stratified use of construction land has a certain theoretical and practical foundation, and can be scientifically and systematically designed in legislation.
