论消费者隐私权的法律保护

【摘要】:在科技尤其是电子、通讯和网络技术迅猛发展的今天,侵犯消费者隐私权的事件日益增多,消费者私生活面临的威胁和侵害愈加严重。毋庸置疑,保护消费者隐私权是维护正常的社会再生产的需要,,也是保护公民权利的具体体现。在我国,法律没有把隐私权确立为一项独立的、主要的人格权,只是借助司法解释并通过保护名誉权的方式以维护公序良俗的隐私权是不完备、不周密的。本文从消费者隐私权的基本概念入手,在分析国外隐私权的相关立法经验基础上,结合我国现行立法,提出我国消费者隐私权法律保护的缺陷并提出完善我国消费者隐私权的法律保护建议。本文分四个部分对消费者隐私权的法律保护进行了较为全面的阐述。 第一部分论述消费者隐私权的概念、内涵以及特征。消费者隐私权包括知情权、选择权、利用限制权、收益权和安全保障权五项内容,呈现出主体特定化、客体扩大化、财产价值更突出三大特点。 第二部分主要利用比较法,介绍美国、德国、日本、法国及其他国家隐私权法律保护的现状。通过比较分析,域外启示有三点:一是在法律保护方式上我国应采取直接保护;二是在保护模式上我国必须有强制性的立法干预;三是我国应关注对网络隐私的保护立法。 第三部分重点说明我国消费者隐私权立法和司法保护现状。总结当前我国消费者隐私权法律保护存在的问题主要表现在三个方面:一是消费者隐私权保护立法滞后;二是消费者隐私权保护司法欠缺;三是现有法律对消费者隐私权的保护不能适应经济及技术快速发展的要求。 第四部分是本文的重点,针对我国消费者隐私权保护存在的问题,分别从立法、司法、法制教育三个方面提出具体可行的完善我国消费者隐私权法律保护制度的措施。立法上,在完善隐私权法律保护体系基础上建立健全消费者隐私权立法,包括在《消费者权益保护法》中增加“消费隐私权”制度、制定一部综合性的《消费者隐私权保护法》和制定《电脑个人数据保护法》保护消费者网络隐私权;司法上,简化小额消费纠纷的诉讼程序、设置特别的消费者保护法庭、建立有利于消费者维权的诉讼费用制度;法制教育上,通过各种方式加强对政府、经营者、消费者的法制宣传与教育工作。
[Abstract]:With the rapid development of science and technology, especially electronic, communication and network technologies, the number of violations of consumers' privacy rights is increasing, and the threats and infringements on consumers' private lives are becoming more and more serious. There is no doubt that, Protecting consumer privacy is the need to maintain normal social reproduction, and it is also a concrete embodiment of the protection of civil rights. In our country, the law does not establish the right of privacy as an independent, primary personality right. It is not complete and thorough to maintain the public order and good custom privacy by means of judicial explanation and the way of protecting reputation right. This paper starts with the basic concept of consumer privacy, and analyzes the relevant legislative experience of foreign countries. Combined with the current legislation of our country, this paper puts forward the defects of the legal protection of consumer privacy in our country and puts forward some suggestions for perfecting the legal protection of the right to privacy of consumers in our country. This paper expounds the legal protection of the right to privacy of consumers in four parts. The first part discusses the concept, connotation and characteristics of consumer privacy. Consumer privacy includes the right to know, the right to choose, the right to use restrictions, the right to profit and the right to security protection. Property value more prominent three major characteristics. The second part mainly uses comparative law to introduce the current situation of the legal protection of privacy in the United States, Germany, Japan, France and other countries. Through comparative analysis, there are three points: first, our country should take direct protection in the way of legal protection; The second is that our country must have mandatory legislative intervention in the mode of protection, and the third is that our country should pay attention to the protection of network privacy legislation. The third part mainly explains the current situation of legislation and judicial protection of consumer privacy in China. It summarizes the problems existing in the legal protection of consumer privacy in our country: firstly, the legislation of consumer privacy protection lags behind; The second is the lack of judicial protection of consumer privacy, and the third is that the protection of consumer privacy by existing laws cannot meet the requirements of rapid economic and technological development. The fourth part is the focal point of this paper, aiming at the problems existing in the protection of consumer privacy in China, respectively from the legislative, judicial, Three aspects of legal education put forward concrete and feasible measures to improve the legal protection system of consumer privacy in China. In legislation, on the basis of perfecting the legal protection system of the right to privacy, we should establish and improve the legislation on consumer privacy. Including adding a "consumer privacy right" system to the Consumer Rights and interests Protection Law, formulating a comprehensive "Consumer Privacy Protection Law" and formulating the "computer personal data Protection Law" to protect consumer network privacy; judicially, To simplify the litigation procedures for small consumption disputes, to set up special consumer protection courts, and to establish a system of litigation expenses in favor of consumers' rights; and to strengthen legal education through various means to the government and operators, Consumer's legal publicity and education.
