监护侵害处理意见:激活“沉睡的制度”

【摘要】：《关于依法处理监护人侵害未成年人权益行为若干问题的意见》比较全面地确立了处理监护人侵害未成年人权益行为的八项制度。这八项制度开启了未成年人保护的新起点,激活了近二十八年来的"沉睡的制度",无疑将对未成年人保护起到重要的作用。但目前我国未成年人保护工作还存在着诸多问题,面临着新挑战,因此国家有关部门需要尽快进行调研,就具体制度的落实给予指导;基层相关公职人员要转变观念,积极落实《意见》;加大未成年人救助保护资金投入,健全基层未成年人救助保护机构;激发社会组织活力,发展专业的儿童保护社工和法律人才;发挥居(村)委会的排查功能,及时反馈监护侵害案件。
[Abstract]:The opinions on dealing with some problems of guardian's infringing upon the rights and interests of minors according to law established eight systems for dealing with the acts of guardian infringing upon the rights and interests of minors, and these eight systems opened a new starting point for the protection of minors. The activation of the "sleeping system" in the past 28 years will undoubtedly play an important role in the protection of minors. However, at present, there are still many problems in the protection of minors in our country and they are facing new challenges. Therefore, the relevant state departments need to conduct investigation and research as soon as possible to give guidance on the implementation of the specific system; relevant public officials at the grass-roots level should change their concepts and actively implement the "opinions"; and increase the investment in funds for the relief and protection of minors. It is necessary to improve the organizations for the relief and protection of minors at the grassroots level; to stimulate the vitality of social organizations, to develop professional social workers and legal personnel for child protection; to give play to the function of the resident (village) committees in the investigation and investigation, and to provide timely feedback on cases of infringement.
