认可、吸纳与空漏:《民法总则》对习惯的规范及完善

【摘要】：《民法总则》的通过和即将实施表明我国民法典的编纂迈出重要的一步。总结《民法总则》中关于习惯的规范,对于理解《民法总则》、思考民法典编纂中有关习惯的科学安排有积极意义。《民法总则》对习惯进行了直接的认可规定,确认了习惯法的正式法源地位。《民法总则》对习惯进行了隐含规定、吸纳规定,体现了对我国民事生活内生规范的尊重。同时,《民法总则》在有关习惯方面还存在空漏状况,需要在编纂民法典、整体完成民法典时予以弥补和完善。在民法典分则编制定和民法典整体编纂时,需要认真总结现有民事法律关于习惯的规定,总结司法解释中有关习惯的规定,总结学界有关民事习惯的论著,更需要认真进行民事习惯调查。
[Abstract]:The adoption and implementation of the General principles of Civil Law indicate that the compilation of the Civil Code in China is an important step forward. In order to understand the General principles of Civil Law, it is of positive significance to think about the scientific arrangement of custom in the compilation of Civil Code. It confirms the status of the formal legal source of the customary law. The General principles of Civil Law implicitly stipulate and absorb the custom, which reflects the respect for the endogenous norms of civil life in our country. At the same time, the General principles of the Civil Law still have a vacancy in the relevant habits. It is necessary to make up for and perfect the civil code when it is codified and when the civil code is completed as a whole. In the formulation of the civil code and the compilation of the civil code as a whole, it is necessary to sum up the customary provisions of the existing civil law. It is necessary to make a careful investigation of civil custom by summing up the regulations on custom in judicial interpretation and summing up the academic works on civil custom.
