滨州市金融消费者权益保护研究

【摘要】:随着金融管制体制日臻完善,金融消费者权益保护作为消费者概念在金融领域的延伸,越来越引起高度重视。尤其是美国金融危机爆发以后,全球各国金融监管改革无不将金融消费者保护提到前所未有的高度,世界各国一致认为金融消费者权益保护不到位是导致金融危机爆发的重要原因。金融消费者权益保护关系到金融业能否实现健康快速发展,它与整个金融体系的安全、稳定、高效运行密切相关。从1978年开始,我国政府对于金融的管理以及宏观调控能力逐渐加强。可是,如果和欧美国家比较,国内金融消费者权益的保护仍相对欠缺,具体表现在法律法规以及监管体系等方面。2014年3月15日正式实施的新消费者权益保护法将金融消费者权益保护纳入监管范围。对拥有维护金融稳定和改善金融市场服务重要职责的人民银行而言,维护金融消费者合法权益义不容辞。为进一步适应金融消费者权益保护的新形势,中国人民银行的基层行按照2013年5月出台的《中国人民银行金融消费者权益保护工作管理办法(试行)》规定,积极创新,努力探索,在维护金融消费者权益方面取得了阶段性成果。滨州市人民银行成立了专门的消费者保护协会,同时不断完善保护制度,努力寻求维护消费者权益的新途径。本文阐述我国开展金融消费者权益保护工作的重要意义,并从金融交易的供给方、需求方、监管方三个角度对中外理论研究成果进行了梳理,借鉴美、英、日等发达国家的消费者权益保护的实践经验,结合2014年滨州市消费者权益保护情况,着重分析滨州市金融消费者权益保护的现状、投诉咨询特点以及银行卡类、征信类等不同类型案例,剖析问题产生的原因,从健全法律制度、完善监管机构框架、加强金融消费者教育等不同角度,对维护金融消费者权益提出工作思路,以期促进金融消费者权益保护制度不断完善。
[Abstract]:With the improvement of the financial regulation system, the financial consumer rights and interests protection, as an extension of the consumer concept in the financial field, has attracted more and more attention, especially since the outbreak of the financial crisis in the United States. Financial regulatory reforms around the world have brought financial consumer protection to an unprecedented high. Countries all over the world agree that inadequate protection of the rights and interests of financial consumers is an important reason leading to the outbreak of the financial crisis. The protection of the rights and interests of financial consumers is related to whether the financial industry can achieve healthy and rapid development, and it is safe and stable with the entire financial system. Efficient operation is closely related. Since 1978, our government has gradually strengthened its financial management and macro-control capabilities. However, if compared with European and American countries, the protection of domestic financial consumers' rights and interests is still relatively lacking. On March 15, 2014, the new law of consumer rights and interests protection will be included in the scope of supervision. To maintain financial stability and improve the financial market. For the people's Bank of China, which plays an important role in service, In order to further adapt to the new situation of protecting the rights and interests of financial consumers, it is incumbent upon them to safeguard their legitimate rights and interests. The grassroots banks of the people's Bank of China, in accordance with the regulations of the people's Bank of China on the Administration of Financial Consumer Rights and interests Protection (for trial implementation) promulgated in May 2013, actively innovate and make efforts to explore, In safeguarding the rights and interests of financial consumers, the Binzhou Municipal people's Bank established a special consumer protection association and constantly improved the protection system. Try to find a new way to safeguard the rights and interests of consumers. This paper expounds the importance of developing the protection of the rights and interests of financial consumers in China, and from the supply-side and demand-side aspects of financial transactions, Regulators have combed the theoretical research results of China and foreign countries from three angles, drawing lessons from the practical experience of consumer rights and interests protection in developed countries such as the United States, Britain and Japan, and combining with the situation of consumer rights and interests protection in Binzhou City in 2014. Focusing on the analysis of the current situation of financial consumers' rights and interests protection in Binzhou, the characteristics of complaint consultation and different types of cases, such as bank cards, credit information, etc., the causes of the problems are analyzed, and the legal system is improved and the regulatory framework is improved. In order to improve the system of protecting financial consumers' rights and interests, this paper puts forward some ideas on how to protect the rights and interests of financial consumers from different angles such as strengthening financial consumers' education.
