完善在校实习生意外伤害赔偿制度法律规定探究

【摘要】：随着我国教育事业的飞速发展,各大高校不断扩大其招生规模,越来越多的在校生即将走上社会,书写人生新篇章。在毕业之际,大部分学校会安排毕业生到相关单位进行实习,再或者是毕业生为了促进就业,自行到单位申请实习等等,导致在各个领域的实习生人数也与日俱增,伴随而来的是在实习期间频发的各种各样的法律问题,特别是在某些危险系数极高的岗位,造成在校实习生意外伤害的情况也更为突出,但是,由于法律本身固有的局限性,我国法律并没有将在校实习生意外伤害问题加以规范和明确,从而也就导致在校实习生实习期间发生意外伤害后,出现了寻求法律救济不能找到合理依据的情况,在校实习生个人的合法权益也得不到应有的保障和救济。如何能够很好地解决在校实习生意外伤害赔偿问题,是笔者重点阐述和研究的内容。本文主要通过两则案例引出目前在校实习生意外伤害事故困境,分析现行的法律规定,探讨目前存在的诸多不足及其成因,就具体如何完善我国在校实习生意外伤害赔偿制度法律规定,提出相关的建议。
[Abstract]:With the rapid development of education in China, colleges and universities continue to expand their enrollment scale, more and more students will soon enter the society, writing a new chapter in life. At the time of graduation, most schools arrange for graduates to go to relevant units for internships, or graduates apply for internships in order to promote employment. As a result, the number of interns in various fields is also increasing day by day. This is accompanied by a variety of legal problems that occur frequently during internships, especially in certain positions with extremely high risk factors, which cause accidental injuries to interns at school, but due to the inherent limitations of the law, The law of our country does not standardize and clarify the problem of accidental injury of intern in school, which leads to the situation that the legal remedy cannot be found after the accidental injury occurred during the intern practice period in our country. The legitimate rights and interests of the intern in school also can not get due protection and relief. How to solve the problem of compensation for accidental injury of intern is the focus of my research. This article mainly through two cases leads to the plight of the current intern accident accident, analyzes the current legal provisions, discusses the existing deficiencies and their causes. This paper puts forward some suggestions on how to perfect the legal provisions of the compensation system for accidental injury of intern in our country.
