基于系统动力学的企业专利运用法律风险研究

【摘要】：结合企业专利运用周期,通过分析企业专利运用过程中风险因素的产生和演化特点,从企业自身实力、专利运用业务流程和国家政策环境三个模块构建系统动力学模型,并采用Vensim PLE软件进行仿真。通过对仿真模型的有效性和灵敏度的验证分析,表明该模型能较好地对企业专利运用过程中的法律风险及企业经济损失演化过程进行拟合,能对企业专利运用策略进行评估,为决策者的策略选择提供理论依据,为企业适用不同环境的专利运用的法律风险提供理论指导。
[Abstract]:Based on the analysis of the characteristics of risk factors in the process of patent application, the system dynamics model is constructed from three modules: enterprise strength, patent application business process and national policy environment. Vensim PLE software is used for simulation. The validity and sensitivity of the simulation model are verified and analyzed. It shows that the model can fit the evolution process of legal risk and enterprise economic loss in the process of patent application, and can evaluate the strategy of enterprise patent application. It provides a theoretical basis for the decision makers' choice of strategies, and a theoretical guide for the legal risk of the application of patent in different environments.
