夹缝中的兴盛:论农地“三权”抵押的法禁令行

【摘要】：掌握在农民手中的集体土地主要有宅基地、承包经营的耕地、林地等"三地",与之相适应的农村房屋所有权、耕地承包经营权、林权称之为农地"三权";禁止"三权"抵押的法律规定,与农村改革、农业经济发展严重背离,允许转让却限制抵押的立法自相矛盾,导致集体农地权利、权能残缺不全;抵押是"三权"融资担保的最佳方式,国家推行"三权"抵押政策,有利于盘活农民的土地财产权利,有利于农业经营规模扩大和农村经济持续发展。为此,应当将"三权"抵押政策上升为法律,及时修订与之相悖的法律法规。
[Abstract]:The collective land in the hands of farmers mainly consists of homestead, cultivated land contracted for operation, woodland and other "three lands", corresponding to the ownership of rural houses and the right to contract and manage cultivated land, Forest right is called "three rights" of agricultural land, the legal stipulation that forbids "three rights" mortgage, deviates seriously from rural reform, agricultural economic development, permits the transfer but limits the mortgage legislation contradiction, causes collective farmland right, the power is incomplete; Mortgage is the best way to guarantee the financing of the "three rights". The implementation of the "three rights" mortgage policy is beneficial to the development of farmers' land and property rights, to the expansion of the scale of agricultural management and to the sustainable development of rural economy. Therefore, the "three rights" mortgage policy should be raised into law and the contrary laws and regulations should be revised in time.
