“一带一路”的贸易便利化与海关知识产权保护的互动

【摘要】："一带一路"贸易便利化与海关知识产权保护在本质上并非对峙关系,而是互相兼容的。一方面,"一带一路"战略丰富了传统的贸易便利化理论的内涵与外延,是海关知识产权保护恪守的指南;另一方面,海关知识产权保护辅助并加速"一带一路"的贸易便利化进程。为了保持两者高度契合的关系,需要克服贬抑贸易便利化的国内立法和区域性国际法的诸多问题,包括海关知识产权保护备案的国内立法和国际合作机制的弊端,国际联合担保尚未被推而广之,反担保在国内立法中的适用过于狭窄,以及贯通欧亚大陆、过境欧盟时遭遇的不公正执法问题等。为了弥补上述偏弊,一方面建议签署更多具有实质内容的海关知识产权合作协议,推动TIR单证式的联合担保;另一方面,建议修订《知识产权海关保护条例》,扩充反担保所适用的外延,细化申请书需要登记的有关事项,增加因疏于信息更新义务所必须给予的惩戒。
[Abstract]:Belt and Road's trade facilitation and the protection of customs intellectual property rights are not antagonistic in nature, but compatible with each other. On the one hand, the "Belt and Road" strategy enriches the connotation and extension of the traditional trade facilitation theory and is a guide to the protection of customs intellectual property rights; on the other hand, Customs intellectual property protection assists and speeds up the trade facilitation process of Belt and Road. In order to maintain a highly compatible relationship, there is a need to overcome the many problems of domestic legislation derogating from trade facilitation and regional international law, including the shortcomings of domestic legislation and international cooperation mechanisms for the protection of customs intellectual property rights, International joint guarantee has not been extended, the application of anti-guarantee in domestic legislation is too narrow, and the unfair law enforcement problems encountered in the transit of EU through Eurasia, etc. In order to remedy the above shortcomings, on the one hand, it is proposed to sign more substantive customs intellectual property cooperation agreements to promote TIR documentary joint guarantees; on the other hand, It is suggested that the regulations on Customs Protection of intellectual property Rights should be amended to expand the extension of the anti-guarantee, to refine the relevant items that need to be registered in the application form, and to increase the punishment that must be given because of the omission of the obligation to update information.
