个人信息处理中同意原则适用的困境与破解思路

【摘要】：信息技术让人们发现了信息的经济价值和社会价值,也给个人信息安全带来了巨大威胁。为了保护个人信息免于被非法收集、滥用或泄露,国内、国际的相关法律规范均采用了权利人同意原则。随着大数据技术的发展,同意原则在实践中没有达到制度设计的目的,陷入了实施成本过高、有效性值得怀疑和阻碍信息自由的困境。文章在分析同意的内涵、理论基础和国外实践的基础上,探讨了同意原则适用困境的原因与本质,有针对性地提出了解决思路。研究认为"同意"是个人自治的必然要求,维护了人的尊严,有其存在的理论和现实基础。同意原则适用的效果不理想并不代表它不重要,更不能否定其存在的必要性和正当性。要破解同意困境,需要明确同意原则适用的范围和形式,更需
[Abstract]:Information technology not only makes people discover the economic and social value of information, but also brings great threat to personal information security. In order to protect personal information from illegal collection, abuse or leakage, domestic and international legal norms have adopted the principle of consent of the obligee. With the development of big data's technology, the principle of consent has not achieved the purpose of system design in practice, and has fallen into the dilemma of high cost of implementation, validity of which is worthy of doubt and hindering the freedom of information. Based on the analysis of the connotation of consent, the theoretical basis and the practice abroad, this paper discusses the reasons and essence of the dilemma of application of consent principle, and puts forward some ideas to solve the problem. The research holds that consent is the necessary requirement of individual autonomy, which preserves human dignity and has the theoretical and practical basis of its existence. The fact that the application of the consent principle is not ideal does not mean that it is not important, nor can it deny the necessity and legitimacy of its existence.
