论聚合类新闻模式运行的法律障碍及其克服

【摘要】：聚合类新闻通过对传统媒体和门户网站等媒体发布的新闻和资讯进行筛选、整理和汇总,根据用户的喜好推送相关的新闻资讯,这种模式受到用户喜爱,具有节约筛选资讯时间、有针对性、方便快捷等特点。该种因为新媒体所催生的新闻模式具有保障公众信息获取与促进传媒产业发展的价值。尽管当前司法实务中的判例,对聚合类新闻模式是否构成对著作权侵权或是否构成不正当竞争侵权存在不同的判决。但现有判决构成著作权侵权或不正当竞争侵权的判例表明,聚合类新闻模式继续运行确实存在著作权侵权与不正当竞争侵权的法律障碍。鉴于该种新闻模式所具有继续运行的价值,立法与司法不应该扼杀该种新闻模式的继续运行,而是应该促进该种模式的发展。立法上,应该以尊重权利和利益平衡为原则,在《著作权法》中增加一种新的法定许可,以使聚合类新闻模式得以继续运行。而在立法上调整到位之前,司法实践对于聚合类新闻模式侵犯著作权与不正当竞争侵权的案例,应该谨慎适用永久禁令,避免因为法院的判决而扼杀聚合类新闻模式的继续运行。
[Abstract]:Through screening, collating and summarizing news and information released by traditional media and portals and other media, aggregating news and pushing relevant news information according to users' preferences, this model is popular with users. It has the characteristics of saving time of screening information, pertinence, convenience, etc. The new media news mode has the value of ensuring public information access and promoting the development of media industry. In spite of the current jurisprudence in judicial practice, there are different judgments on whether the aggregative news mode constitutes copyright infringement or unfair competition infringement. However, the existing jurisprudence of copyright infringement or unfair competition infringement shows that there are some legal obstacles to copyright infringement and unfair competition infringement. In view of the value of the news mode, legislation and judicature should not stifle the continuing operation of the news mode, but should promote the development of the model. In legislation, the principle of respecting the balance of rights and interests should be taken as the principle, and a new legal license should be added to the copyright Law so that the mode of aggregating news can continue to run. Before the legislative adjustment is put in place, the judicial practice should apply the permanent prohibition carefully to the cases of infringement of copyright and unfair competition in the convergent news mode. Avoid stifling the continued operation of the aggregated news model because of the court's decision.
