网络财产继承问题研究

【摘要】：自从“红月”玩家李宏晨诉“红月”运营商北极冰公司案后,法学界就掀起了网络财产的研究热潮。经过众多学者多年的努力,网络财产的属性问题得到了较为充分的研究,此时其继承问题就逐渐进入了人们的视野。国内外相继出现了一些有关网络财产继承的纠纷,绝大多数都是以继承人一方的失败而告终。此时继承人就会向法律寻求帮助,因此有必要对网络财产继承问题进行研究。本文第一部分对美国、俄罗斯、韩国和德国等国家与网络财产继承相关法律进行研究,探明各主要国家关于网络财产继承的现状和制度,通过对我国有关网络财产继承的法律法规进行梳理及与域外网络财产继承制度的对比,指出网络财产无法纳入我国《继承法》第三条所规定的遗产范围,需要对其进行修改、完善,以保护、调整网络财产继承关系。第二部分对网络财产继承是否必要进行论证。通过对网络财产中蕴含的应受法律保护的法益进行分类讨论分析,进而得出当前对其继承是十分必要的结论。第三部通过分析网络财产符合财产的具有价值、使用价值和稀缺性特征以及遗产的时间限定性、范围限定性、合法性和财产性特征,指出网络财产属于财产和遗产,网络财产继承是具有可行性的。第四部分对网络财产继承进行制度设计。针对我国目前法律规定的不足之处以及网络财产继承的实际需要,对其继承中涉及的主体、客体、方法、程序等制度进行初步的建构,以期对促进网络财产继承贡献绵薄之力。
[Abstract]:Since Red Moon player Li Hongchen v. Red Moon operator Arctic Ice Corporation, the legal community has set off a wave of online property research. Through the efforts of many scholars for many years, the problem of the property of network property has been fully studied, and then the problem of its inheritance has gradually entered the people's field of vision. At home and abroad, there have been some disputes about the succession of network property, most of which ended in the failure of the successor. The heirs will seek help from the law, so it is necessary to study the inheritance of internet property. In the first part of this paper, we study the related laws of the United States, Russia, South Korea and Germany, and find out the present situation and system of the network property succession in the major countries, such as the United States, Russia, South Korea and Germany, and so on. By combing the laws and regulations concerning the inheritance of network property in our country and comparing it with the system of inheritance of network property outside China, it is pointed out that network property cannot be brought into the scope of heritage stipulated in Article 3 of the inheritance Law of China, and it needs to be revised. Perfect, in order to protect, adjust the network property inheritance relationship. The second part demonstrates whether the inheritance of network property is necessary. This paper discusses and analyzes the legal interests which should be protected by law in the network property, and then draws the conclusion that it is necessary to inherit it at present. The third part points out that network property belongs to property and heritage through the analysis of its value, use value and scarcity, as well as the time limit, scope limitation, legitimacy and property characteristics of the property. Network property inheritance is feasible. The fourth part carries on the system design to the network property inheritance. In view of the deficiency of our country's current law and the actual need of network property inheritance, this paper constructs the system of subject, object, method, procedure and so on, in order to make a small contribution to the promotion of network property inheritance.
