失独老人养老政府责任的保障措施研究

【摘要】：中国的计划生育政策是在人口数量过高、增长速度过快的国情下提出来的,这一政策确实有效地控制了人口数量,缓解了我国即将面临的人口压力,缓和了人与自然之间的矛盾,推动了经济的发展和社会的前进。但是在计划生育政策的引领下,我们国家近些年来出现了越来越多的独生子女家庭,独生子女家庭数目的增多使得他们自身面临着巨大的家庭风险。从宏观角度来看,在整个人类的成长历程中难免会因为各种因素的阻碍导致个体死亡,所以当独生子女家庭面临独子早逝的情况时,父母的养老问题就显得尤为严峻。本文第一部分对所要研究的失独老人进行了概念上的界定,认为在国家计划生育政策的要求下,只生育或者只合法收养一个孩子,并且遭遇了独子早逝厄运的这一群体可以被称作失独者。本文仅讨论失独者中的未再生养或者未合法收养子女的老年父母,称之为失独老人,并重点关注失独老人的养老问题。然后从内部原因和外部原因两个方面对失独老人产生的具体原因进行了详细的分析,通过对失独老人经济状况和精神状况的阐述表明了失独老人的现实养老困境,从而提出了失独老人的养老问题。接着,着重研究失独老人养老的政府责任,重点阐述政府承担养老责任的原因,即失独老人因履行国家政策而无人养老、失独老人是弱势群体及政府对失独老人予以保护是社会主义制度的基本要求;第二部分从三个方面分析了政府承担责任的现状,并指出了相关法律法规的不足,即目前法律法规中II经济扶助标准较低、养老机构相对不足且入住困难以及精神需求难以满足;第三部分提出了政府承担责任的保障措施,建议提高经济扶助的标准、加强失独老人养老机构的设置和文化建设来满足失独老人的精神需求以及规定专门的管理机构和监督机构。
[Abstract]:The policy of family planning in China is put forward under the conditions of high population and too fast growth. This policy has effectively controlled the population quantity, alleviated the population pressure that China was about to face, alleviated the contradiction between human and nature, promoted the development of the economy and the progress of the society. Under the guidance of our country, more and more only child families have appeared in recent years. The number of single child families has increased to make them face huge family risks. From a macro perspective, it is unavoidable that in the whole human course of growth, it is unavoidable to cause individual deaths due to the hindrance of various factors, so as a single child family. In the first part of this paper, the first part of this paper has a conceptual definition of the old man who has been studying, and thinks that under the requirements of the national family planning policy, the group that only has a child or only legally adopts a child, and that the first death of the only child can be called. This article only discusses the old parents who have not regenerated or legally adopted their children in the individual who have lost their independence. They call it the old man who lost the independence of the old man, and focus on the old man's pension problem. Then it analyzes the specific reasons for the old man from two aspects of internal and external reasons, and through the economic form of the old man who has lost the independence of the independent man. The expounding of the situation and mental state shows the old man's dilemma of the old man, and then puts forward the old-age problem of the old man who has lost one's independence. Then, it focuses on the government responsibility of the elderly who lost the old man, and focuses on the reasons for the government to bear the responsibility for the aged, that is, the old man is the disadvantaged group and the government because of the implementation of the state policy. The protection of the elderly is the basic requirement of the socialist system; the second part analyses the status of the responsibility of the government from three aspects, and points out the shortcomings of the relevant laws and regulations, that is, the II economic assistance standards are low in the current laws and regulations, the relative insufficiency of the pension institutions and the difficulties in the occupancy and the spiritual needs are difficult to meet; third Some measures are put forward to guarantee the responsibility of the government. It is suggested that the standard of economic assistance should be improved, the setting up and cultural construction of the old-age pension institution for the elderly are strengthened to meet the spiritual needs of the old people who have lost their independence, and the special management institutions and supervision institutions are stipulated.
