著作权法视野下视频聚合行为法律定性的思考

【摘要】：从法规范和学理两个角度对视频聚合行为的法律定性进行检视和探讨,在涉及技术类著作权司法审判中,应区分技术本身与技术应用者以及技术中性论与技术价值论,技术与视频聚合行为法律定性没有必然关系;应坚持以法律下的自由为由对视频聚合行为者科以相应的义务;应通过著作权法来修复著作权人与传播者之间失衡的利益分配。
[Abstract]:This paper examines and discusses the legal nature of video aggregation from the angle of law, norm and theory. In the judicial trial involving the copyright of technology, we should distinguish between technology itself and technology application, as well as technology neutral theory and technology value theory. There is no necessary relationship between technology and the legal characterization of video aggregation; we should insist on the corresponding obligations of the video aggregators on the basis of the freedom under the law; we should use copyright law to repair the imbalance between copyright owners and disseminators in the distribution of interests.
