论房屋多重买卖中物权归属之判断标准

【摘要】:房屋多重买卖现象在市场经济快速发展的影响下日趋增多,在交易过程中,出卖人基于房屋的高价值性、市场稀缺性以及刚性需求性等特点将同一房屋出售给多个买受人以寻求经济利益的最大化。然而,现行立法和司法解释对于上述多重买卖现象中的实际履行顺序及物权归属问题至今没有明确的规定,虽然最高人民法院为指导正确适用法律处理房屋多重买卖中产生的权利纠纷拟定了相关规定,但是该规定的合理性仍存有一定的探讨空间。有鉴于此,本文在分析房屋多重买卖特征、比较不同物权变动模式下物权归属的判断标准以及考察我国关于房屋多重买卖物权归属之判断标准的司法实务和学说理论的基础上,划分房屋多重买卖的具体表现类型,评析不同情形下物权归属判断标准的适用,并对房屋多重买卖中的物权归属问题提出了一些自己肤浅的看法。本文除“引言”和“结语”外,由以下四个部分构成:第一章“房屋多重买卖概述”,通过厘清房屋多重买卖的内涵及具体表现形式,概括了房屋多重买卖的特征,并分析了房屋多重买卖在一定的时代、社会、经济背景下发生的条件与原因。第二章“各种立法模式下物权归属之判断标准”,通过比较不同法系的不同物权变动模式以及不同物权变动模式下关于物权归属的相关法律规定,分析了国外立法在物权变动中确定物权归属的判断标准。第三章“房屋多重买卖中物权归属之判断标准”,通过整理学说理论关于多重买卖中履行顺序及物权归属的不同观点,并在此基础上结合我国司法实务中的相关规定和指导意见,分析了我国目前关于房屋多重买卖中物权归属之判断标准的立法概况。第四章“房屋多重买卖中物权归属之我见”,通过分析房屋多重买卖中的合同效力,在划分房屋多重买卖类型的基础上,就房屋多重买卖中各种具体情形下物权归属的判断标准进行选择,确定了具体情形下的履行顺序及物权归属,并对拟定中的相关司法解释提出了一些自己的意见。
[Abstract]:Under the influence of the rapid development of the market economy, the phenomenon of multiple purchase and sale of houses is increasing day by day. In the course of trading, the sellers are based on the high value of the houses. The characteristics of market scarcity and rigid demand sell the same house to multiple buyers in order to maximize economic benefits. However, the current legislation and judicial interpretation of the above phenomenon of multiple transactions in the actual order of performance and ownership of property has not been clearly defined. Although the Supreme people's Court has formulated relevant provisions to guide the correct application of the law to deal with the rights disputes arising from the multiple purchase and sale of houses, there is still room for discussion on the reasonableness of this provision. In view of this, this paper analyzes the characteristics of multi-transaction of house, compares the judgment standard of property ownership under different real right change mode, and investigates the judicial practice and theory about the judgment standard of property ownership of house multi-transaction in our country. This paper classifies the concrete expression types of the multiple sale of houses, analyzes on the application of the judgment standard of the ownership of real right under different circumstances, and puts forward some superficial views on the ownership of the real right in the multifold purchase and sale of houses. In addition to "introduction" and "conclusion", this paper is composed of the following four parts: chapter one, "A summary of the multiple transactions of houses", summarizes the characteristics of the multiple transactions of houses by clarifying the connotation and specific forms of expression of the multiple transactions of houses. The paper also analyzes the conditions and causes of the multi-sale of houses in certain times, society and economy. The second chapter, "judging standard of ownership of real right under various legislative models", compares the different modes of real right change in different legal systems and the relevant legal provisions about property right ownership under different modes of real right change. This paper analyzes the criterion of determining the ownership of real right in foreign legislation. The third chapter, "the judgment standard of property ownership in the multiple purchase and sale of houses", through sorting out the different viewpoints on the order of performance and the ownership of real right in the multiple transaction theory, On this basis, combined with the relevant provisions and guidance in the judicial practice of our country, this paper analyzes the legislative survey of the judgment standard of the property right in the multi-purchase and sale of houses in our country at present. Chapter four, "my opinion on the ownership of Real right in the Multi-sale of Housing", through the analysis of the effectiveness of the contract in the multi-transaction of the house, on the basis of dividing the type of the multi-transaction of the house, This paper makes a choice on the judgment standard of the ownership of real right under various specific circumstances in the multiple transactions of houses, determines the order of performance and the ownership of the real right under the specific circumstances, and puts forward some opinions on the relevant judicial interpretation in the future.
