合理原则在与知识产权相关的反垄断问题中的适用--理论上的合理性及执行中的困难

【摘要】：与知识产权相关的反垄断法问题的核心,是如何在知识产权追求的动态效率与反垄断法维护的静态效率之间取得某种平衡。这种平衡的取得需要对个案具体问题进行具体分析,即适用合理原则或基于效率的分析方法。本文在阐明合理原则与当然违法原则内涵的基础上,进一步分析在与知识产权相关的反垄断问题中适用的合理性以及执行中的困难,提出可能的解决方案。
[Abstract]:The core of anti-monopoly law related to intellectual property is how to strike a balance between the dynamic efficiency pursued by intellectual property and the static efficiency maintained by anti-monopoly law. In order to achieve this balance, it is necessary to analyze the specific problems of individual cases, that is to say, to apply the principle of reasonableness or the analysis method based on efficiency. On the basis of expounding the connotation of the principle of reasonableness and the principle of illegality of course, this paper further analyzes the rationality of the application in the antitrust problems related to intellectual property and the difficulties in the implementation, and puts forward the possible solutions.
