住宅建设用地使用权期满自动续期问题研究

【摘要】：住宅建设用地使用权期满自动续期是法律明文规定的制度。自动续期指的是权利人不需要申请,不需要签订新的合同。为了使该项权利成为一项“一次取得永久使用”的用益物权,对续期的次数和期限不应当予以限制。至于自动续期是有偿还是无偿,从法律漏洞的填补规则出发,应当规定为无偿续期为宜。但是,“权利不是没有边界的”,应当对自动续期的客体——住宅建设用地使用权予以适当限制。另外,加收房地产税或者是住宅建设用地使用权持有税应当是适当的政策选择。综上,本文大致包含如下六个部分:第一部分,引言。该部分简要介绍了我国自动续期制度的研究现状,并就此引出了本文论题。同时,也适当说明了研究方法和思路。第二部分,事件介绍与争议焦点。该部分引入了时下反响热烈的两个案例,并归纳了三个争议焦点。即,能否自动续期,续期有偿还是无偿,对该项续期权利有无限制。第三部分,对自动续期的解读。该部分系统归纳了我国关于自动续期的现行立法,并且阐释了自动续期的程序性要件,即不需要申请,不需要签订合同,即可完成续期。第四部分,对无偿续期的分析。由两部分组成,一是相关学说梳理,二是解决路径。第五部分,对续期权利的限制。这部分是本文的精髓所在。包括两个方面:权利范围的再界定以及房地产税征收的相关事宜。第六部分,结语。该部分总结全文,指出今后较长时间内研究续期制度的重点和应注意的问题。
[Abstract]:The automatic renewal of the right to use residential construction land is a system expressly stipulated by law. Automatic renewal refers to the right-holder does not need to apply, do not need to sign a new contract. In order to make this right a usufruct of "one acquisition of permanent use", the number and duration of renewal should not be limited. As to whether the automatic renewal is paid or unpaid, it should be stipulated that it is appropriate to renew without charge from the rules of filling the legal loophole. However, the right is not borderless, and the right to use land for residential construction should be appropriately restricted. In addition, the imposition of real estate tax or residential land use right holding tax should be the appropriate policy choice. In summary, this paper contains the following six parts: the first part, introduction. This part briefly introduces the research status of automatic renewal system in China, and leads to the topic of this paper. At the same time, the research method and train of thought are also properly explained. The second part is the introduction of events and the focus of controversy. This part introduces two popular cases and concludes three controversial points. That is, whether the right of renewal can be automatically renewed, paid or unpaid, there are no restrictions on the right of renewal. The third part, the interpretation of automatic renewal. This part systematically summarizes the current legislation on automatic renewal in our country, and explains the procedural elements of automatic renewal, that is, the renewal can be completed without application and without signing a contract. The fourth part, the analysis of the free renewal. It is composed of two parts, one is the related theory combing, the other is the solution path. The fifth part, the limitation of the right of renewal. This part is the essence of this paper. Including two aspects: the redefinition of the scope of rights and real estate tax related matters. The sixth part, conclusion. This part summarizes the full text and points out the key points and problems to be paid attention to in the future.
