我国专利行政处罚制度及其立法完善

【摘要】：目前,《专利法修改草案(送审稿)》中涉及行政处罚的内容仍存在问题:一是赋予县级专利行政部门以执法权有待商榷,二是专利行政部门对涉嫌"侵犯专利权行为"案件实施调查取证会对一方当事人显失公平。结合我国专利行政处罚权的设定以及相关制度进行比较分析得出:县级专利行政部门仍不具备对专利侵权行为以及专利违法行为实施行政裁决、行政处罚以及行政强制措施的能力;行政权主动调查取证的介入仅限于假冒专利行为或扰乱市场秩序的故意侵权行为;在《专利行政执法办法》的进一步完善中需要细化行政处罚的程序规则,并删除违反上位法规定而设定行政处罚的相关条款等。
[Abstract]:At present, there are still problems in the contents of the revised draft of the Patent Law concerning administrative penalties: first, giving the administrative department of patent at the county level the power to enforce the law is open to discussion. Second, the patent administrative department will be unfair to one party to investigate and collect evidence in case of patent infringement. Based on the comparative analysis of the establishment of patent administrative penalty power and related systems in China, it is concluded that the county patent administrative department still does not have the administrative ruling on patent infringement and patent violation. The ability of administrative punishment and administrative coercive measures; the intervention of administrative power to investigate and collect evidence is limited to the act of counterfeiting patent or intentionally infringing the market order; It is necessary to refine the procedural rules of administrative punishment in the further improvement of Patent Administrative Law Enforcement measures and to delete the relevant provisions of administrative punishment set in violation of the provisions of the upper law.
