论知识产权侵权诉讼中合法来源抗辩的构成要件

【摘要】：作为《著作权法》《商标法》《专利法》等都予规定的不侵权抗辩手段,合法来源抗辩被广泛适用于上述知识产权侵权诉讼中。但是,其法律适用却呈现出严重不统一现象。建议以民法典知识产权编的论证与编纂为契机,将三大知识产权法中的合法来源抗辩条款予以提炼,统一规定于民法典知识产权编,将其构成要件统一为"侵权者系主观善意、侵权产品系合法取得、说明提供者信息",并对"不知道""合法取得""说明提供者信息"等术语作出解释,以统一法律适用,维护司法权威。
[Abstract]:As a non-infringement defense provided in the copyright Law, the Patent Law, and so on, the legal source defense is widely used in the intellectual property infringement litigation mentioned above. However, the application of the law presents a serious phenomenon of disunity. It is suggested that taking the argumentation and compilation of intellectual property rights of the civil code as the turning point, the legal source defense clauses in the three major intellectual property laws should be refined and unified in the intellectual property rights part of the civil code, and the constituent elements should be unified as "the infringer is subjective and bona fide". The infringing product is legally obtained, the information of the provider is stated ", and the terms" do not know "," legally obtain "and" explain the information of the provider "are explained so as to unify the application of the law and safeguard the judicial authority."
